AN ORDINANCE CONCERNING LAND USE AND SIGN DISTRICT CLASSIFICATION AND AMENDING THE ZONING MAP AND SIGN DISTRICT MAP OF THE CITY OF EUGENE, OREGON THE CITY COUNCIL OF THE CITY OF EUGENE FINDS THAT: ~~ Pursuant to the provisions of ORS 221.215. and Sections 8.813, 9.278, and 9.668 through 9.684 of the Eugene Code, 1911, the City Council has the authority and responsi bi 1 i ty, subject to the 1 imitations contained therein, to change the zoning and sign district c1 ass i f i cati on of prap,erty within the City of Eugene; . As a part of that district, the property described i n Exhibit "A" i s subject to the speci a1 district development standards of the Fifth Avenue Development District. Those standards .are as fal l ows : ~_ 1. Description and Purpose Section The area generally known as the Fifth Avenue Development District has been classified as an SD Special Development District i n order to achieve the fol 1 awi ng purposes a. To allow preservation of the existing substantial buildings ; b. To allow redevelopment of the area with a vari ety of commercial and industrial uses ; c. To encourage redevelopment which is primarily pedestrian- ori ented with only l imi ted pravi si on for automobile use; and d. To insure that new development conforms with the character of the existing development. In order to achieve the purpose of this particular special district, i t i s necessary that an asso~ci ati on of al l property owners involved be formed. This association shall assume, at a minimum, those responsibilities hereinafter detailed. ' 2. Use Section The purpose of this district is to encourage a variety of uses. In line with that purpose, only those uses which are vehicle- oriented shall be expressly excluded as new developments or redevelopments ~e.g., service stations, warehouses, repair garages , drive-i n facilities , etc. } . Within this broad framework, individual proposals sha11 be evaluated on the basis of consistency with the expressed purpose of this district. A conditional use permit shall be required for a1 ] new level op- ment or redevelopment in the area. when making findings concerning a proposed development, the Hearings Official shall take into consideration in the manner hereinafter provided the recommendations of the special development district associ ati an . 1891{ EXHIBIT "B" Page Z 3. Development Standards (z s2-s) In this special development district the general standards set forth in the City Code governing development in the C-2 Community Commercial District shat 1 prevai 1 except as expressly provided for below: . a. 0n-site parking wi 11 not be required where existing buildings are used. b, R11 new development when possi b1 e} shal 1 provide parking i n. excess of its own needs to accommodate parking generated by ~_ redevelopment, c. Provision of parking shal 1 be the responsi bi 1 i ty of the special development district association rather than individual tenants or property owners. d. While not requiring the provision of parking in accordance with the normal standards set forth in this code, it will be the responsi bi 1 i ty of the special development district to p~novi de additional parking in the event demonstrated parking problems are created by development in this special district. Determinations concerning the extent of any alleged parking problem and the amount of parking necessary to resolve the prabl em shall be made by the Hearings Official through the conditional use permit procedures. e. All new development proposals and redevelopment proposals within the speci a1 development di stri ct.wha] 1 be reviewed by a design.rev~ew team selected by the special development district association. One member of the Eugene Planning Department Staff shall serve an an ex-officio voting member of the design review team. A favorabl e report from this design revi ew~ team shal ] be necessary prior to approval of any proposal by the Hearings' Offi cal . 4. .Public Facilities Within this speci a1 development District, the fo11 owi ng improvements shat 1, be ,provided at the expense of the special development district assac~at~on: a. Brick paving for sidewalks similar to that installed in front of the Granary; b. Installation of a median strip on Fifth Avenue with trees and ground cover; c. Removal of curbside parking except for short-time 1 oath ng zones ; 1891 EXHIBIT "B" _ Page 3 d. Provision for sheltered bus stop; and e. Provision of street lights, either pole-mounted or building- mounted. Other improvements installed at~public expense within this special development district area shall be designed to coordinate with the improvements listed above. 5. All proposals for new development or redevelopment shall be considered by the Hearings Official for issuance of a condi ti oval ~- use permit in accordance with the procedures set forth in Section 9.696 et. sea, of the City Code.
