AN ORDINANCE ESTABLISHING THE 2-~l INDUSTRIAL
DISTRICT; AMENDING SECTIONS 9.254, 9.268, 9.510,
9.534, 9.540, 9.542, 9.544, 9.546, 9.582, 9.586,
AND 9.595 OF THE EUGENE CODE, 1971; ADDING SEC-
TIONS 9.442, 9.443, 9.444, 9.445 TO THAT CODE;
AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN A5 FOLLOWS:
Section 1. Section 9.254 of the Eugene Code, 1971 is hereby
amended by adding in alphabetical order therein, the fallowing:

Industr_ia1_,,,,park. Any planned industrial develop-
ment designed as a coordinated environment for a vari-
ety of industrial and industrially related activities,

SIC. The Standard Industrial Classification
Manual. When the acronym "SIC" is used in conjunc-
tion with a number it refers to those establishments
that are included in the numbered group in the Stand-
ard Industrial Classification Manual, Executive Office
of the President, Office of Management and Budget,
Washington, D.C., U. S. Government Printing Office,
1972, or as subsequently amended.
Section 2. Subparagraph ~a} of Section 9.268 of the Eugene
Code, 1971, is hereby amended by adding before "M--1 Limited indus~-
trial district" the following:

Section 3. Subsection ~7} of Section 9.510 of the Eugene Code,
1971, is hereby amended by relettering subparagraph ~c} to ~d} and
adding a new subparagraph ~c} thereto, to read and provide:

9.510 General Provisions

Section 4. Subsection ~3} of Section 9,534 of the Eugene Code,
19?1, is hereby amended by adding a new subparagraph ~c} thereto,
to read and provide:
9.534 Building,,Hei~ht Li,mita,tions.
~3} Industrial:
~c} In the T-1 district, no building height
shall obstruct solar radiation to:
1. Other main building roof tops in indus-
trial or commercial zoning districts,
2. Potential main building roof tops 20
feet in height in buildable areas in industrial
or commercial zo~n~ing districts; or,
3. Existing or potential south-facing
building walls in buildable areas in residential
zoning districts.
As used in this section, "solar radiation" is the su p-
light generated on becember 21 of any year between l0
a.m, and 3 p.m, standard time.
Section 5. Subparagraph Via} of subsection ~.3} of Section 9.540
of the Eugene Code, 1871, is hereby amended to read and provide:
9.540. Front Yards
~.3} Industrial:
~a} Except as provided in sections 9.532 to 9.574,
all lots or development sites in the I-1 and M-~1 dis-
tricts shall have a front yard of at least 30 feet.
Section 6. Subsection ~3~ of Section 9,542 of the Eugene Code,
l9?1, is hereby amended to read and provide:
9.542 Interior Yards.
~3} Industrial: All lots or development sites in the
I-1, M-l, M--2, and M-3 districts shall have no interior yards
required where said lots yr development sites abut praperty
lines of commercially or industrially zoned property. When
side or rear property lines of said districts are common with

property zoned residentially, interior yards shall be at least
20 feet in the I~-1 district and at least 10 feet in M~-l, M-2,
and M-3 districts when opposite the residential districts.
Section 7. Subparagraph 3, of subsection ~.e} of Section 9.544
of the Eugene Code, 1971, is hereby amended to read and provide:

3. In any commercial yr industrial district,
except C-l, I-l, and M-1, parking areas or spaces
shall be permitted in any required yard. See sec-
tion 9.542 ~_2} and ~.3} . } In the I-l district park-
ing areas or spaces may be located in required
front yards if more than 20 feet from all abutting
streets.
Section 8. Section 9.546 of the Eugene Cade, 1971, is hereby
amended by renumbering the present subsection ~2} to ~3} and adding
a new subsection ~2} thereto, to read and provide:

within an individual area designated "special light industrial"
on the Metropolitan Area General Plan Diagram, or area that
would be contiguvus~if nat separated by streets, roads, ease-
ments, natural features, ar the like, shall conform to the
following size requirements, regardless of ownership:
~.a} Subsequent to issuance of building permits
and initiation of construction of one or two major uses
listed in section 9.443 ~_c} to (z} when those uses re-
quire, or will ultimately require, far their operation
a total of at least 54 contiguous acres:
1. Office buildings and complexes:
Minimum: Two acres,
Maximum: Ten percent of the area
zoned I~-1.
2. Industrial parks:
Minimum: Ten acres,
Maximum: None.
3. Other uses listed in section 9.443~c}

Section 9. Section 9.582 of the Eugene Code, 1971, is hereby
amended to read and provide:

be provided on the development site for all AG, RA, R-l,
C--l, I-1, M-1, M-2, and M--3 zones . In all other zones, the re-
quired parking shall be on the development site or within 440
feet of the development site which the parking is required to
serve. All required parking must be under the same ownership
as the development site served, except through special covenant
agreements as approved by the city attorney, which bind the
parking to the development site. Off-street parking is not re-
quired in the C-3 district, except far dwelli°ng units. In I-1
districts, when practical, off-street parking and loading area s
shall be designed to share access to public and private streets,
Likewise, contiguous lots in industrial parks shall be designed,
when practical, as a group so as to limit access to private and
public streets.
Section 10.
Subparagraph ~_d} of Section 9.586 of the Eugene
Code, 1971, is hereby amended by adding a new subsection 5, thereto.

Section ll. Section 9.598 of the Eugene Code, 1971, is hereby
amended to read and provide:

cess of required parking spaces.
~2} In the I--l district all off-street loading spaces
and uses shall be on interior service courts or screened from
view at eye level from all property lines by;

years} planting of evergreen plant materials which
attain a mature he~,ght of at least six feet; or,

When necessary, screening shall also have accaustical properties
which augment the activity's ability to conform to the noise
standards in section 9.644.
Section 12.
The f al lc~~ving new sections are hereby added to
the Eugene Code, 1971, to read and provide:
9.442 Description and Purpose.
~.1} The purpose of the I-~l Special Industrial District
is to protect and enhance the sites identified as Special Light
Industrial in the Metropolitan Area General Plan in order to
efficiently accomodate large concentrations of specialized light
industrial and related uses, These uses:
(.a} Have re~.atively large numbers of employees
per acre;
(b} Do not generate offensive external impacts
or tolerate noise, pollution, or substantial emissions;
and,
~.c } Require locations near major thorvughf ayes
and nonmariufacturing areas.
~.2} Fox these reasons, development is limited to the
following three categories of mutually compatible uses needing
parklike settings:
~a} High-technology manufacturing;
fib} Freestanding offices; and
~.c} Planned industrial parks containing light
manufacturing uses and related service and trade acti-
vities.
9.443 Permitted Buil,d,n,~s_„ a,n~ ,,,Uses. In the I-1 special in-
dustrial district, the following buildings and uses are
permitted, subject to the general provisions and exceptions
set forth in sections 9.445 and 9.532 to 9.662. Items within
parentheses are only descriptive. Buildings and uses actually
permitted in those situations are precisely listed in the Stand-
ard Industrial Classification SIC} Manual as defined in section

9. 4 Buildin _ __ _

equipment, excluding all but computers and peripheral

combined gross floor space of all such uses does not
exceed 20 percent of the total gross floor space of all
buildings on the site or 15% of the real property area
of the site:

1. Restaurants, excluding drive-ins and
those restaurants which sell a substantial amount
of goods for consumption off the premises, and
which. sell prepared foods and drinks for consump-
tion on the premises;
2. hanks, credit unions, trust companies,
and savings and loan institutions engaged in the
business of accept~,ng deposits from the public
and extending credit by means of loans or invest-
ments.
9.445 I-l District - General provisions.
~.1} In addition to applicable previsions contained
elsewhere in the zoning ordinance, the following general pro-
visions apply in the I-1 district. In the event of a conflict,
the provisions of this section apply.
~.2} Landsca in The fol~.owing restrictions shall
apply to all buildings and uses:
~.a} Required yards, berms, and screening shall
provide a parklike character for the property.
fib} At least 2a percent of the portion of the
site to be developed sha~.l be landscaped with living
plant materials. A larger percentage may be required
if necessary to make positive findings for site review
approval.
Vic} vegetation shall not infringe on the solar
access required in section 9.534 ~3} ~.c} ,
C_d} D'nused portions of otherwise developed prop-
erty shall be maintained ~,n an uncluttered, dust free,
and attractive manner.
fie} .All plant z~ateria~, shall be maintained by a
permanent irrigation system,
~f} If required landscaping cannot be completed
prior to occupancy, the approving authority may re-
quire the applicant to post a performance bond in an
amount sufficient tv assure rapid completion.
C.3} Under~round_,u.tilities. Unless waived by the city,
the developer shall locate underground all on-site utilities.
~4} Industrial ark sate review a roval rocedure.
Industrial parks benefit from a coordinated and compatible en-
vironment as can be achieved through site review approval.
Therefore, the site review procedures as set forth in sections
9.686 to 9.694, shall apply, subject to the fallowing modifica-
tions:
~.a} Industrial_ p,a,rk des,i,~n_,team. Development
plans submitted as part of an industrial park site re-
view approval shall be prepared by a design team com-
prised of a project architect, engineer, and landscape
architect who are licensed in the state of Oregon, one
of whom shall serve as coordinator, fine or more members

of the design team must certify that building, elevation,
site, and landscape plans submitted in connection with
the site review and building permit applications comply
with applicable ~-l district provisions and conditions
of approval.
~.b} Site review rocedures. Buildings and uses
within an industrial park as provided for in the I-l
district shall be approved in accordance with site re-
view procedures set forth in sections 9.686 to 9.694,
except that written affirmative findings as stated be-
low shall be required in lieu of those found in section
9.688
1. The proposed development is consistent
with standards, glans, policies, and ordinances
of the city.
2. The proposed development is of general
design and character, ~_including but not limited
to ant~,cipated building design, type, location,
bulk, height, looation, and distribution of land-
scaped area, parking, roads, and access which
will not create problems for the appropriate devel--
opment of abutta.ng properties and the surrounding
area.
3. The proposed development will create an
attractive, safe, efficient, and stable internal
environment.
4. Proposed buildings, roads and other uses
will be designed and sited to ensure preservation
of significant on--site vegetation, topographic fea-
tures, and other unique or worthwhile natural
features so as to prevent soil erosion or flood
hazard.
5. There will be adequate on-site provisions
for utility services, emergency vehicular access,
and public transportation facilities if on exist-
ing or proposed transit routings,
~5~ Use cynyersl~ons. In no event shall manufacturing
or industrial establishments be converted to retail or whole-~
sale uses, partially or otherwise, except as specifically pro-
vided for in this district.
Section 13.
The provisions of this ordinance shall be reviewed
by the City Council twenty-four months after its adoption in order
to determine if its terms operate to inhibit the marketing and use
of those parcels to which it is applied. It is the intent of the
Council that the I-1 zoning District be applied to those parcels

within the City of Eugene which are identified as "Special Light
~~ Industrial" in the Metropolitan Area General Plan.
Section 14. That the provisions contained herein concern the
public welfare and safety and therefore, an emergency is hereby de--
Glared to exist,.and this Ordinance shall become offective imrnedi~-
ately upon its passage by the City Council and approval by the Mayor.
