HomeMy WebLinkAboutOrdinance No. 19011oRDZNANCE No. 19n~~ AN ORDINANCE CONCERNING PAYMENT 4F CITY ~3ILLS, AMENDING SECTIQNS 2.525 AND 2.527 of THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: Except as provided by law, whenever an authorized agent of the City executes a contract for material and/or services, the City be- comes committed to pay for the materials and/or services that meet the specifications of the purchase agreement. The Charter provisions and state law on the expenditure of public funds primarily provide a remedy for the City to recover from a public official any unlawful expenditure rather than provide the City with grounds to refuse to pay for materials and services 1 it has received. The City Manager, as business agent of the City Council, is authorized to make expenditures and may further delegate that res- r possibility to others in the organization. The City Council establishes its control over expenditures when it adopts the municipal budget appropriating its revenues. It establishes the purposes for which the revenues are "assessed, collected, raised or levied"'. Reasonable controls exist in the state law, the City Charter, and with the City administration to insure the City Manager and his or her designee, will expend public money properly. It will allow the City to mare economically pay its bills and claims if they are paid routinely rather than waiting until City Council meetings. ordinance - 1 r9o-~ Now, therefore, based upon the above findings, THE CITY OF EUGENE DOES oRDAIN AS Fo~,LO~i~S Section 1. Section 2.525 of the Eugene Cade, 1971, is hereby amended to read and .provide: 2.525 Finance officer - Authori2ation to Issue Checks. {1} Provided that expenditures do not exceed the adopted appropriation and are for purposes approved in the adopted budget, the finance officer may issue checks drawn on city bank accounts to pay city bills and claims. ~2} The provisions of this section and the provi- sions of section 2.527 da nat apply to funds deposited in or disbursed .from the risk n~anagement fund, which are governed solely by the provisions of section 2.585. Section 2. Section 2.527 of the Eugene Code, 1971, is hereby amended to read and provide: 2.527 Finance officer -- of f ical Register of A proved Claims . ~ l } The finance officer shall maintain an official register of all approved bills and claims. The register shall designate the check number, date of issue, payee, and amount of each check. ~2} The register shall be presented to the council upon the council's request. Section 3. That the matters contained herein concern the public welfare, and based thereon; and upon the findings contained herein, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
