HomeMy WebLinkAboutOrdinance No. 19012ORDINANCE No. 19012 AN ORDINANCE CONCERNING THE PURCHASE OF ART AND PERFORMING ARTS SERVICES; AMENDING SECTIONS 2.856 AND 2.859 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY The City Council of the City of Eugene finds that: From time to time the City purchases works of art and the services of performing and visual artists. Artists and works of art are unique, and purchases of art must take into account the particular purposes for which the purchase is made, the need for diversity in the types of art purchased, and the desirability of encouraging artistic freedom and innovation. The public interest would best be served by the exemption from formal bidding and quotation requirements of all contracts for the purchase of works of art or artists' services, as hereinafter defined. Favoritism would not be encouraged, cam-- petition would not be diminished, and substantial savings to the City would result if such contracts are exempted from the City's formal bidding and quotation requirements, NOw, THEREFQRE, based upon the above findings, THE CITY OF EUGENE DOES ORDAIN AS FDLLOwS: Section l: Section 2.856 of the Eugene Code, 1971, is hereby amended by adding the following new definitions, in alphabetical order, to provide: Performin Artists. Practitioners in the performing arts who are generally recognized by critics and peers as professionals of serious intent, including but not limited to practitioners of dance, theater and music. Ordinance -- 1 1902 visual Artists. Practitioners in the visual arts who are generally recognized by critics and peers as pro- fessionals of serious intent, and who produce works of art. Works of Art, All forms of original creations of visual art, including but not limited to: Painting: all media, including bath portable and permanently-affixed or integrated works such as murals. Sculpture: in the round, bas_reli of , high relief , mobile, fountain, kinetic, electronic, etc., in any material or combination of materials. Prints, clay, drawings, stained glass, mosaics, pho- tography, fiber and textiles, wood, metal, plastics and other materials or combination of materials, calligraphy, and mixed media, any combination of forms of media, including collage. Section 2: Section 2.859 of the Eugene Code, 1971, is hereby amended by the amendment of subsection ~g~ and the addition of a new subsection shy , to provide: ~g 7 Contracts for the purchase or commissioning of works of art. ~h~ Contracts for the services of performing artists or visual artists. Section 3: The provisions contained herein concern the public welfare and therefore an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
