AN ORDINANCE CONCERNING THE PURCHASE GF LIBRARY
MATERIALS; AMENDING SECTION 2.859 OF THE EUGENE
CODE, 1971, AND DECLARING AN EMERGENCY
The Gity Council of the City of Eugene finds that:
From time to time the City purchases library materials,
including books, periodicals, sound recordings, films, film
strips, maps, and other printed or published materials.
Timeliness and reliability of supply are critical to effec-
tive public library service, since patrons demand new books when
they are new, particular editions of individual titles, re-
cordings by specific artists, and complete runs of periodical
subscriptions. Association with a major book jobber is necessary
to guarantee reliable and prompt service. A major book jobber
has access to an automated supply system and an extensive ware-
house, ensuring that books published by hundreds of publishers
will be readily available. Due to its volume of business, a
major book jobber is frequently able to provide a larger discount
than smaller booksellers.
The advantages gained by association with a major book jobber
would be unavailable if the City were to comply with formal
bidding and quotation requirements with respect to the purchase
of library materials. Consequently, the public interest would
best be served by the exemption from formal bidding and quotation
requirements of all contracts for the purchase of library

materials, as hereinafter defined. Favoritism would nat be
encouraged, competition would not be diminished, and substantial
savings to the City would result if such contracts are exempted
from the City's formal bidding and quotation requirements,
NOw, THEREFORE, based upon the above findings,
THE CITY GF EUGENE DOES ORDAIN AS FOLLOWS :
Section l: Section 2.859 of the Eugene Code, 1971, is hereby
amended by the addition of a new subsection ~i~ , to provide:
~i} Contracts for the purchase of library materials,
including but not limited to books, periodicals, sound
recordings, films, film strips, maps, and other printed or
published materials.
Section 2: The provisions contained herein concern the
public welfare and therefore an emergency is hereby declared to
exist, and this ordinance shall become effective immediately upon
its passage by the City Council and approval by the Mayor,
