An Qrdinance initiating the vacat.~on of the following described
street, to-wit:
As described on Exhibit "A" attached hereto and
incorporated herein by reference. .City of

THE CITY 4F EUCENE DaES ORDAIN AS FQLLQWS;
Section 1. The City Council of the City of Eugene herein ini-
tiates the vacation proceedings on its own authority without peti-
tion ar consent of the property owners, except as provided by statute,
of the above described street.
Section 2. A hearing shall be held upon the proposal to vacate
the street as herein provided, and the hearing shall be held on the
20th day of October, 1982, at noon Pacific.Daylight Time of said date,
at the Council Chambers at City Hall, Eugene, Oregon, at which time
all persons will be heard upon objections or suggestions with regard
to the vacation, and at said time the Council will provide for the
vacation of the street or deny such vacation, and in case the vacation
is made, will provide and make provision for any damages sustained
by local assessment.
Section 3. The City Recorder is hereby directed to immediately
publish once each week far four consecutive weeks in a newspaper pub-
lisped in Eugene, Lane County, Qregon, notice of the proposed vaca-
tion. The notice shall give a description of the area to be vacated
as herein set out; state the date when this ordinance was passed, the
name of any petitioners petitioning for the vacation, and the date
when the petition, together with any objections or remonstrances which
may be made in writing and filed with the Recorder of the City of

Eugene prior to the date of the hearing, will be heard and considered.
Section 4, The City Recorder shall forthwith and within five
days after the first publication of the notice post, or cause to be
posted, at or near each end of the proposed vacation a copy of the
foregoing, which shall be headed "Notice of Street vacations" and
which notice shall be posted in at least two conspicuous places in ar
on the area proposed to be vacated.
The posting and the first day of publication of the notice shall
be not less than twenty-eight ~.28~ days before the time set for hear-
ing.

Beginning at the northwest corner of Lot 11, Block 3
of Clayton Hills Subdivision as platted and recorded
in Baak 44, Page 28 of Lane County Plat Records; thence
South 89°23' West, 30' along the north boundary of
Clayton Hills, to the northwest earner of Clayton Hills
Subdivision; thence South 7°33'30" East 106.46 feet along
the west baundary of Clayton Hills to the point of inter~-
sectian of westerly extension of the north right-of-way
line of Dellwood Drive and the said west boundary of Clay-
ton Hills Subdivision; thence North 89°18'54" East 60.64
feet along said north right-of-way extension of Dellwood
Drive to a point. South 89°18' 50" West 44.14 feet from the
southeast corner of said Lot ll; thence along the arc of a
40.00 foot radius curve to the right .the long chord of
which bears North 49°07'20" West 53.08 feet} to the point
of compound curve in said Lot 11; thence along the arc of
a 504.56 foot radius curve to the right the long chord of
which bears North 4°05'15" West 61.09`}; thence North 00°
37' West 9.06 feet to the place of beginning all in Section
7, Township 18 South, Range 3 west of the Willamette Meri-
dian. This vacation also includes the 5.00 foot slope ease-
ment easterly of and adjacent to the east line of the herein
above described property. Excepting therefrom the Westerly
14.0 0 feet of the above described property, being 14.0 0 feet
wide adjoining and parallel to the west boundary of Clayton
Hills Subdivision from the north baundary of Clayton Hills
Subdivision to the westerly extension of the north rightwof--
way line of Dellwood Drive.
Also retaining a 12 foot public utility easement over the
northerly 12.0.0 feet of the above described property;
also retaining a 5 foot slope easement over the southerly
5.00 feet of the above described property and a slope ease-
ment over the easterly 5 feet of the westerly 19 feet of
the above described property; and retaining an 11 foot
public utility easement over the easterly 11 feet of the
westerly 25 feet of the above described property,

NOTICE OF STREET VACATIONS
TO ALL PERSONS WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that at a meeting of the City Council
of the City of Eugene, held at the Council Chambers at City Hall,
Eugene, Oregon, on the 8th day of September, 1982, there were passed
by the City Council and approved by the Mayor of the City of Eugene,
Lane County, Oregon, Ordinances setting hearings to be held on the
20th day of October, 1982, at 12.00 noon, Pacific Daylight Time, at
the Council Chambers at City Hall, Eugene, Oregon, for the purpose
of hearing remonstrances and protests against the vacation by Ordi-
nances of the City Council of the fallowing:
STREET VACATION
Vacation of a portion of a 30 foot wide right of way
located on the North side of Dellwood Drive and south
of 37th Avenue; the remaining 14 feet of right of way
being presented improved with a pedestrian/bile path,
all as more particularly described in the above des-
cribed Ordinance, and located between Tax Lots 1704
and 112 - Assessor's Map 18-03-07-3 4.
RESERVING herein public utility easements upon the
ground, beneath the ground, and above the ground
across the North 12 feet and the Vest ll feet of the
vacated area; and slope easements over the south 5
feet and the west 5 feet of the vacated area, and the
right to enter thereupon for purposes of construction,
maintenance and repair.

Vacation of a portion of Dove Lane 18 .feet in width
and running a distance of approximately 110 feet along
the South margin of Dove Lane located east of Echa
Hollow Road, all as more particularly described in the

Lot 2900, Assessor's Map 1704--22-2 2.
RESERVING herein a public utility easement upon the
ground, beneath the ground and above the ground across
the entire parcel, and the right to enter thereupon
for purposes of construction, maintenance and repair.
