An Ordinance initiating the vacation of the following de-
scribed alley, to~-wita
The 12~-foot wide alley in Block 4 of Westmoreland
as retarded in Book S, Page 26, Lane County, Oregon
deeds and records.
Reserving herein an easement for public utilities
above ground, on ground level, and underneath the
ground, and the right of access to construct, re-~
construct, and maintain the same over the above de-

THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene herein ini~
bates the vacation proceedings on its own authority without peti-
tion ar consent of the property owners, except as provided by sta~
tute, of the above described alley.
Section 2. A hearing shall be held upon the proposal to vacate
the alley as herein provided and the hearing shall. be held on the
13th day of June, 1979, at 12:~4 o'clock noon, Pacific Daylight Time
of said date, at the Council Chambers, City Hall, Eugene, Oregon,
at which time all persons will be heard upon objections or sugges-~
bons with regard to the vacation, and at said time the Council will
provide far the vacation of the alley or deny such vacations and in
case the vacation is made, will provide and make provision for any
damages sustained by local assessment.
Section 3. The City P~ecorder is hereby directed to immediate-
ly publish once each week for four consecutive weeks in a newspaper
published in Eugene, Lane County, Oregon, notice of the proposed
vacation. The notice shall give a description of the area to be
vacated as herein set out; state the date when this ordinance was

passed, the name of any petitioners petitioning for the vacation,
and the date when the petition, together with any objections or
remonstrances which may be made in writing and filed with the Re-
corder of the City of Eugene prior to the date of the hearing, will
be heard and considered,
Section 4, The City Recorder shall forthwith and within five
days after the first publication of the notice post ar cause to be
posted, at or near each end of the proposed vacation a copy of the
foregoing, which shall be headed "Notice of Alley Vacation", and
which notice shall be pasted in at least two conspicuous places in
or on the area proposed to be vacated.
The posting and the first day of .publication of the native shall
be not less than twenty-eight ~~S} days before the time set for hear-

of the City of Eugene, held at the Council Chambers, City Hall,
Eugene, gregon on the 2nd day. of May, 1979, there was passed by the
City Council and approved by the Mayor of the City of Eugene, Lane
County, gregon, Ordinances setting hearings to be held on the 13th
day of June, 1979 at 12:00 o'clock noon, Pacific Daylight Time, at
the Council Chambers, City Hall, Eugene, Oregon, for the purpose of
hearing remonstrances and protests. against the vacation by ordinance
of the City Council. of the following:

Beginning at a point being South 87°30' West 10.00
feet and South 2 ° 3 0' East 7.0 0 feet from the north-~
east corner of Lot 53, Packwood, as platted and re-
corded in File 72, Slides 22 and 23, Lane County Oregon
Plat Records; thence South 2°30' East 15,46 feet thence
North 41°14°26" West 19.83 feet; thence North 87°34'
East 12.41 feet to the point of beginning, in Lane
County, gregon.
Above description is subject to easements as they
may exist, title company concurrence and questions

A 10-foot wide pedestrian right of way contiguous
to Lots 12, 13, 2l, and 22, Block 8 as platted and
recorded in Second Addition to Cambridge Park, in
book 53, page 9, Lane County Oregon Deed Records.

The City Council will consider and act upon the proposed vaca-
tions on the 13th day of June, 1979 at l~:~q o'clock noon, Pacific
Daylight Time, at the Council Chambers, City Hall, Eugene, Oregon,
anal will consider an Ordinance vacating the easements described
above. All persons having objections thereto or remonstrances
or protests. are hereby notified to present the same to the City
Council in writing prior to said hearing or at said time and place.
