HomeMy WebLinkAboutOrdinance No. 18394ORDINANCE N0. 39 AN ORDINANCE REGARDING ZAND DEVELOPMENT; AMENDING SECTION 7.279 OF THE EUGENE CODE, 1971; AND DE- CLARING AN EMERGENCY. The City Council of the City of Eugene finds that: The area generally referred to as the Central Business District and hereinafter more particularly described, should be exempt from development taxes because: It is zoned for higher density residential and commercial uses. Higher density use in this area is consistent with goals stated in the 1994 General Plan and the 1974 Community Goals and Policies, the Downtown Westside Plan, Whiteaker Neighbor hood Refinement Plan and T~2444 Transportation Plan, which docu- ments have been adopted by the City Council. It is consistent with the area approved by the City Council for the multiple unit property tax exemption. It would help stimulate private reinvestment which is needed to insure the success of public activities such as the Community Development Block Giant funded neighborhood improvement prograns, and the Central Eugene Renewal Project. It includes areas which have been designated in the 1975 Neighborhood Analysis Update as low-income concentrations, substandard building concentrations, and as being "blighted" or "potentially blighted",. The area lies primarily within f~.re zones ~. and 2. Build-~ ing requirements within these zones are such as to impose an Ordinance ~. 1 1839 ~4} No tax is due under section 7.277 of this code for development by any municipal,, quasi-municipal, or public cor- poration. ~5} Na tax is due under section 7.27? of this code for paving an unpaved parking area before Apri 1 ll , ~ 98~ ~ i f the parking area was continuously used as such and existed before April ll, 1978. k ~6} No tax is due under section 7.277 of this code for development in the following area: Beginning at the intex~sectian formed by 13th Avenue and Washington Street, thence northerly along the center line of Washington Street + 5800 feet to the center 1~ine of the Willamette River, thence easterly along said river center line + 1000 feet to a point that is the intersection of the extension of Lincoln Street and the centerline of the Willamette Rivex, thence southerly along the center line of Lincoln Street + 2500 feet to the center lane of Southern Pacific railroad right-of-way, thence easterly along said railroad right-af-way center line + 2504 feet to the center line of High Street, thence southerly along the center line of High Street + 2300 feet to the center line of lath Avenue, thence westerly along the center line of lath Avenue + 3200 feet to the center line of Washington Streetr to the point of beginning, alb. an Eugene, Lane County, Oregon. Ordinance ~- 3 1839 economic penalty on high density development in these areas. Now, therefore , based upon the above f i,r~dings , THE CITY OF EUGENE DOES ORDAIN AS FOLI~OwS: Section 1. Section 7.2?9 of the Eugene Code, 1971, is hereby amended to provide: 7.279 Development Tax - Exceptions, Qualif.icat~,ans. ~l} No tax is due under section 7.277 of this code for a development located. in the city on or before April 11, 1978, but not then connected to the sanitary sewer system of the city, whose owner has applied for a building permit on or before that date, if the connection to the system is made within 18 months thereafter or within l8 months after the system is accessible to the development, whichever is later. Tf a connection is not made to the system within that time, the owner shall pay the tax computed under paragraph Ca) of subsection (4) of section ?.2?7. ~2} A tax is due under section 7.277 of this code for a change in development only if the change in development has a value exceeding $5,000 and increases ~a} the floor space of the deve~,opment, ~b } the impervious surf ace of the deve lapr~ent, or ~ c }. the tax for the development as computed unde r section 7.277 of this code. ~3} A housing or other development that receives fin- ancial support from the city shall receive a reduction in ar exemption from the tax equal to the amount of financial support the development receives from the city.
