THE CITY QF EUGENE DOES ORDAIN AS FOLLOWS; Section 1. The City Counc%~, dies hereby order a special elec- tion to be held in the City of Eugene, Oregon, concurrently with the Lane County special election on Tuesday, June ~6, 1979, at which elec- tion there shall be submitted, to the electors of the City for their appra~ral or rejection the following measure, to~-wit: ~~IEASURE NO. 5 ~ MEASURE SUBMITTED TO THE VOTERS BY THE CITY COUNCIL A MEASURE Authorizing the City Council to levy, far purposes of the Downtown Development D.~stra,ct, a tax on the ownership of real property in the District, and not elsewhere in the City of $211,56 in excess of the taxation leviable under Article XI, Section 11, of the Constitution of the State of Oregon. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS BE IT ENACTED BY THE ELECTORS OF THE CITY OF EUGENE, OREGON: Ordinance _ 1 18Y~o3 Section 1. For the fiscal period beginning July 1, 1979 and ending June 34, 198Q, the City Council of the City of Eugene, Oregon, is hereby authorized to levy, for purposes of the Downtown Development Di,strct~ a tax of $211,568 on the ownership of real property in the Da.strict, and not else-~ where in the City , which tax i s to be ~i n adds, t a,on to and out- side the constitutional six percent ~.i~m~,tation upon the City's tax levy as set fprth in Article ~I, Section ll, of the Cans ti tut~,on o~ the State of Oregon , Section 2. If this measure is approved, the operating budget of the Downtown Deve~,opment D~,str,ict to be financed by ad valorem taxation for the 1979-~$0 ~~.scal year will be $44,656 less than the operating budget financed by such taxa- tion for the preceding fiscal year. Section 3. This measure shall become effective July 1, 1979. Section 2. The proposed measure shall be placed upon the offi- vial ballot by the City Recorder. There shall be furn~,shed to the County Clerk for Lane County a certified copy of the ballot title for the measure and number o~ the measure t~ be voted upon. The City attorney shall prepare and the City Fecarder shall, furnish a ballot title for the measure and direct that. the County Clerk for Lane County place the measure upon the regular ballot to be used at the Lane Count y special election to be held on June 26, ,1979, to be voted upon by the electors of the City at the special City election. Section 3. The necessary poll books, ballot boxes, tally sheets, Ordinance -~ 2 18NO3 and such other supplies far each precinct as are necessary far the carrying on of the election shall be furnished bar the County Clerk for Lane County, and the supplies shall be de~,a;~vered to the Election Board. Section 4. The City Council hereby orders that the election shall be head as a special election for the City of Eugene concur- rently with the Lane County special e~,ection on Tuesday, June 2~, 1979, .and hereby designates as _t~.e p~ 1~_nc~ Places ~_~r he- election in the .................. - City of Eugene the polling p~.aces established and designated for the Lane County special election, and the City Council does hereby appoint the Clerks appointed to serve at the Lane County special election to serve in each of the polling places for the City election. Section 5. The polls shall ~e open in each of the voting pre~- cincts at 5.00 o~clock a.m,, Pacific Day light Timer and shall be kept open until 8:DD o'clock p.m,, Pacific Day,li~ht Tamer on election day. Section 6. The Clerk acting as chairman of the Election Board in the Lane County special election shall be chairman of the same Board of which he ~r she is a member in the City election, and the ballots shall be counted and tabulated and the results certified as provided by law. Section 7. The City Recorder is hereby directed to give not less than ten days notice of the special election by publication of one notice thereof in the Eugene Re~ister-~Cuard, a newspaper. pub- lished in the City and of general, circulation therein. Section S. The matters contained herein affect the peace, health, and safety of the citizens of the City of Eugene, and, therefore,. an Ordinance ~- 3 184x3 emergency is hereby declared to exist, and this Ordinance shall be- come effective immediately upon its passage b~ the City Council and appro~ral by the Mayor.
