HomeMy WebLinkAboutOrdinance No. 18414ORDINANCE NO.~~~' AN ORDINANCE CONCERNING NOTICE OF HEARINGS OF APPEALS To THE COUNCIL; AMENDING SECTION 2.007 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY THE CITY OF EUGENE DOES ORDAIN AS FoLLOwS: Section 1. Section ~.007~9} of the Eugene Code, 1971, is hereby amended to read and provide: ~9} The council shall establish a hearing panel which shall consist of two councilors, each appointed for three months, to take testimony in appeals to the council regarding: ~a} Street, sidewalk and sewer assessments. fib} Decisions of the zoning board of appeals. ~c} Decisions of the department of parks and recreation as to its rules. Such an appeal shall be heard in public session. The panel shall see that a record of the hearing of the appeal before the panel is kept which shall include minutes of the testimony taken, and documents and exhibits received during the hearing. For each such appeal the panel shall prepare a written report of its findings and recommendations. The report shall be submitted to all members of the council in the week preceding the meeting at which the council takes final action on the appeal. Appellants, those testifying at the initial hearing, and those who, in writing, zequest notice of the appeal hearing shall be mailed one week ~in~ advance notice of the time and place of the council hearing. Further testimony regarding the appeal may be received by the council only with the consent of two-thirds of the members of the council. ordinance -- 1 'I S~f/y~ Section 2. That the provisions contained herein concern the pub~.ic welfare and safety and therefore, an emergency is hereby declared to exist, and this oxdinace shall become effective immediately upon its passage by the City Council and approval by the Mayor.
