Tf during the term of appointment a mem- ber of aboard, commission or committee ceases to be a resi- dent of the city, the position shah. be vacated, effective as of the date a qualified resident of the city willing to serve is appointed to fill the position. The council, by majority vote, may waive th.e residency requ%rement only if there is no qualified resident of the city willing to serve. 2n addition, all appointments that are required to be~made by the council shall be divided into the three following categories: Via} Those appointments which require a personal interview of finalist candidates by the full council, as well as full council review of appropriate citizen interest forms. . fib} Those appointments which do not re wire er- q p sonal interviews before the fu~.l council, but do re- quire full council review far all appropriate citi- zen interest forms prior to appointment. ~.c} Appointments which mare appropriately should be delegated to a con~anittee on boards, com- missions and committees composed of three councilors appointed by the mayor, which is charged with the duty of reviewing the appropriate citizen interest forms and making formal nominations or recommenda- tions for the council's consideration, The provisions contained herein shall apply to mayoxal appoint- ments to council created boards, committees and commissions. ~7} The mayor is requested to furnish to all members of the council in writing, the names of all nominees to an Y board, commission or committee designated in subsections ~1} and ~2} above, who are nominated by him or her, and subject to appointment by the council, prior to consideration by the council. ~l4} All council appointments to membership on the boards, commissions and committees set forth in subsection ~1} of this section shall be reviewed by the council in January of each year. ~.ll} ~Vacan~cies on boards, commissions and committees, including special council committees, shall be filled in the same manner as original appointments, as set forth in subsec- tion ~:6} above, unless those procedures are in conflict with the ordinance, resolution or state law creating the same. ~~.2 } ~u~suant to the ~~requ~emerits and pro~~sions of section 294.336 of Qregon Revised Statutes, a bud et committee g Ordinance - 7 Is4zi shall consist of all members of the council and a like number of qualified electors of the city, one from each ward, who shall be appointed pursuant to the following: ~.a} on yr before the fourthMonday in the month of January of any year, vacancies in the office of appointive members of the budget committee from any ward shall be filled by appointment by the council. The councilor representing the ward in which the va~- cancy occurs shall be responsible for recommending to the council the appointment v.f a qualified elector from that ward. fib} Appointive members of the budget committee shall be appointed far terms of three years, and sub- sequently, upon recommendation of the councilor from the ward represented, and subject to council approval, may be reappointed to such position upon expiration of the term originally appointed for, vacancies in the appointive~membershp of the budget committee shall be filled in the same manner as original appoint- ments . Section 2. Subsection ~l} of Section 2.Q50 of the Eugene Code, 1971, is amended to read and pro~ride: 2.050 Airport Commission ~ Created; Terms. ~.l} There is hereby created an Airport Commission, hereinafter referred to as ~'~comrnission", wh%ch shall consist of seven members nominated by the mayor and appointed by the council. The Chairman of the Aviation Committee of the Eugene Area Chamber of Commerce shall be an ex~officia and non-voting member of the Airport Commission. H%s or her term shall co~- incide with his or her term as Chairman of the Aviation Com- mittee. Other ex--~of f ico members ray be appointed by the mayor; however, they shall act in an advisory capacity and may not vote. Section 3. Section 2.x71 of the Eugene Code, 1971, is hereby amended to read and provide: 2.071 Room Tax S~ubco~ttee~ ~~ C~reateal. There is hereby created a room tax subcommittee of the budget committee, hereinafter ref erred to as the '~ subcommittee" , which shall con- sist of seven members nominated by the mayor and appointed by the council. Section 4. Subsection ~:5} of Section 2.072 of the Eugene Code, 1971 is amended to read and provide: 2.072 Roam Tax Subcommittee ~~ Memb~ersh , Terms. ~5 } A vacancy an the subcommittee shall be f .filled for the unexpired term created by the vacancy in the~same manner as original appointments. Ordinance - S is~~~ Section 5. Section 2.082 of the Eugene Cade, 197,, is amended to read and provide: 2.082 Civic Center Co~i~ss~ion ~- Me~be~ship, Term of 4~ffice. ~l~ The commission sha~,l consist of 15 members nomi- nated by the mayor and appointed by the council. The members of the commission shall include two counc%lors and persons rep- resentative of business, labor, neighborhood groups and planning interests, the downtown business community, education, the per~- farming arts community, and the general public. ~~2 ~.. Vacancies in office shall be filled in the same manner as original appointments, ~.3 ~ ~ ~'ollow~ng completion and final acceptance of the project by the council, the cammissa,on'~s authority will cease and it shall be abolished. Section 6. Section 8. Subsection ~_l~ of Section 2, 254 of the Eugene Code, 1971 is amended to read and provide: 2.254 Joint Housing Committee ~ Membership. [1~ The membership of the committee shall consist of: Via} One councilor, nominated by the mayor and appointed by the council; ~b~ A member from the planning commission, appointed by the commission; and ~_c~ Three members from th.e public, interviewed and appointed by the council Ordinance - 9 18~+2i Section 9 . Subsections ~.2 ~ and ~:3 } ~ and the first paragraph of subsection ~4 ~ of Section 2.2 6 0 of the Eugene Code , 19 ? 1 are amended~to read and provide: 2.260 Commissions on T~u7ma~n Vii: hts ~2~ Each commission shah, cor~s~,st of nine members. The council shall appoint the members and fill any vacancies, after interviews and recommendations by the council subcommittee. Members of the commissions sha~,l be appointed through a public process which includes open applications and interviews of the finalists by the council subcommittee.. In order to provide con- tinuity, initial appointments shall include three members selected for a one-year term, three members selected for a two- year term, and three members selected for a three-year term. The terms of initial appointees shall commence with the date of appoint- ment. Thereafter all appointments shall be to fill an unex- pired term or for a three--year term, as the case may be. ~_3~ In addition to the members appointed by the council, the mayor, city manager, city attorney, or their designees shall be ex officio, nonvoting merrtbers of the commissions. ~.4~ To the extent practical, the members of the com-~ missions shall be representative of the racial, religious, and other groups within the cityR Commission members shall not re- ceive any salary or compensation. The council ~,n appointing members to the commissions shall endeavor to determine that the individuals selected have demonstrated interest i~n or knowledge of the problems of discrimination of the type that is the parti- cular concern of the commission upon which they serve. Section 10. Subsection ~~~ of Section 2.293 of the Eugene Code, 1971, is amended to read and provide: 2.293 Library hoard - Establishment, Me~ibership~ Procedure. ~2~ The board consists o~ f%ve members nom;%nated by the mayor and appointed by the council Section 11. Section 2.330 of the Eugene Codes 1971, is amended to read and provide: 2.330 Plannin ~ Comm%ssl.pn ~ Cam ~ ost,on; Term; ~~acancies; Etc. (1~ The commission shall cQnsi,st of nine members to be appointed by the council. Not more than two members of the commission may be city officers, who shall serve as ex officio nonvoting members. ~2} Members of the commission shall hold office far four years, except city officers appointed as ex off icio mem- bers shall hold office at the pleasure of the council, ~3~ any voting men~be~ who misses more than six conse- cutive regular meetngs~w~;thout having been given a leave of ab- Ordinance - l0 18'421 Bence by the council shall be removed by the council, and another member shall be appointed by the council to complete the unexpired term of such member* ~4~ Commission members shah, receive no compensation but shall be reimbursed for duly authorized expenses. ~5~ Any vacancy in the commission shall be filled by the council for the unexpired term of the predecessor in office. Section 12. Section 2.331 of the Eugene Code, 1971 is amended to read and provide: 2.331 Plannin Commiss.~on ~-~ Remo~ral. A pl~ann.ing co~unission member may be re~ioved by the council, after hearing, for misconduct or nonperformance of duty. Section l3. Section 2.382 of the Eugene Code, 1971, is amended to read and provide: 2.3 8 2 Downtown Deve lopn~en~t ~H~o~ard ~ Membership . The Downtown Development D~oar~d shah. have eleven members, nine ar mare of whom shall each be the proprietor, manager, or assist- ant manager of a business with a sites in, carry on an occupa- tion headquartered in, or own property in, th.e Downtown Develop- ment District, and as such represent the persons and property upon which at this time primarily rests the financial burden of the program mentioned in section 2.3$1 of this code. The mayor shall appoint each initial member- of the board in consul- tation with the Eree Parking Committee of the Eugene Downtown Association. Subsequent members shall be nominated by the mayor and appointed by the council* In the appointments the board shall be made as broadly representative as possible of the various types of economic enterprise being carried on in the Downtown Development District, Section 14. Section 2.384 of the Eugene Code,. 1971 is amended to read and provide: 2.384 Downtown D~e~relop~nent hoard '- vacancies. An office on the Downtown Devel~apn~ent Hoard shall became vacant upon its incumbent's death; resignation; or removal by the council, after consultation with the board, for disability or inatten- tion to the board's business. Section 15. Section 2.404 of the Eugene Codes 1971 is amended to read and provide: 2.404 Historic ~Reyi~ew ~B:oard ~~ Creat.on. ,fin historic review board of seven members is hereby created, vot~.ng mem- bers of the board shall be the director of the Zane County ordinance - ll x$421 Pioneer Museum, and four citizens who have knowledge or inter- est in the areas of local history, architecture, or finance and who have been nominated by the mayor and appointed by the council. Each ~roting member shall be entitled to one vote. The directors of the public works and planning departments, or their designees, shall serve as non-voting members of the board. All members of the board shall serve without compensation. All voting members, except the director of the Lane County Pioneer Museum, shall serve for four~yes,r terms except the f i,rst appointees who shall serge .for the following terms: Two voting members shall be appointed ini ti~l~,y fox tw~o~-year terms ; and two voting members shall be appointed .initially for four--year terms. The director of the Lane. County Pioneer N~useum shall serve during his/her tenure in that position. Vacancies in office shall be filled in the same manner as original appoint- ments and the appointee shall hold office far the remainder of the unexpired term. A voting member who is absent for more than four consecutively scheduled meetings without having been excused by the board shall be removed and the vacancy filled. Section 16. Section 3.564 of the Eugene Code, 1971, is amended to read and provide: 3.560 Public Solicitations Commission. There is hereby created a public solicitations commission which shall consist of the following members: one representative of the police department appointed by the city manager and one repre-~ sentative from the finance department appointed by the city manager. There shall be the fallowing members nom~.nated by the mayor and appointed by the council: one member from the Eugene Area Chamber of Commerce; one member from the United Appeal; and three members representing the public at large. Terms of the initial appointments shall be staggered se that at least one term, but not more than two terms, expire in any one succeed- ing year. Thereafter each term shall be for four years. Upon a vacancy occurring, a successor shall be nominated by the mayor and appointed by the council for the balance of the term. At the first meeting of the commission the members shall select, by majority vote, a chairman and vice chairman. All members shall serve without campens~ation or additional compensation in the case of employes of the city ~ The f ,finance officer sha~.l appoint a recording secretary from his department who shall not have a vote in commission matters, but shall be responsible for keeping the record of the commission. Section 17 . Subsections ~1 ~ and ~_2 ~ of Section 8.130 ~ of the Eugene Code, 1971, are amended to read and provide: 8.130 Electrical Board. ~.1~ Creation. There is hereby created an electrical board which shall herein be known as the 'bboard''. The board ordinance ~ 12 is~z~ shall consist of three members: an electrical contractor; an electrical engineer; and a journeyman electrician who shall be nominated by the mayor and appointed by the council. The elec~ trical inspector shall be an ex officio member and shall act as secretary to the board. ~~ ~. Terms and removal of me~bers . The members of the board shall hold off~.ce during a three--year period following their appointment or until a~successor has been appointed. Cne member shall be appointed each year. Upon expiration of a term of any member, he or she may be reappointed to serve additional terms. The council shall have the power to remove any member of the board at any time for malfeasance in of f ice, incapacity or neglect of duty. Section l8. Section 8.574 of the Eugene Code, 1971 is amended to read and provide: 8.574 Uniform Plumbin Code - Eoard o~ Plumber E~arniners. The board of plumber exa~iners shall be under the de- partment having jurisdiction provided for by law and unless otherwise provided for shall consist of five ~ 5 ~ members : two ~2 3 qualified plumbing contractors, two ~2 } qualified j ourney- men plumbers and one ~1~ member from the public at large.. Cne ~1~ member of the department shall act as secretary and serve as an ex-officio member. Members of the board shall be nominated by the Mayor and appointed by the council. The members of the board shall serve for one year, or until their successors have been appointed. Section l9. Section 8,8Q1 of the Eugene Code, ~.9?1 ~is amended to read and provide: 8. S41 Si n Code ~oa~rd~ ~~f~ ~Appeal~s ~ Creation. There is hereby created a board to be mown as the sign code board of appeals, hereinafter referred to as the "board". ~a} Members of the board shall be nominated by the mayor and appointed by the council. The board shall consist of five members representing the .interests of the city as a whole, and having nonfinancial interest in the sign industry, and one member from the sign in- dustry who shall ha~re no vote.
