HomeMy WebLinkAboutOrdinance No. 18441ORDINANCE NO. ~g~{~{~ An Ordinance repealing Ordinance ~Io. 18429 and initiating the vacation of the following described alley, to-wit: The alley running through flock 3, Plat of Blair Street Addition as recorded in Book 3 of Plats, Page 9, Records of Lane County, Oregon. RESERVING herein an easement for public utilities above ground, on ground level and underneath the ground, and the right of access to construct, re- construct and maintain the same over the above des- cribed alley. ~Ralls - AV 78-3~ On the 16th day of May, 1979, the City Council of the City of Eugene passed Ordinance No. 15395 the 27th day of rune, 1979, at th{ Eugene, Oregon, at which time and could be heard as to the proposed alley. The hearing was head at that setting a hearing to be held on s Council Chambers at City Hall, place protests and remonstrances vacation of the above described time and place, and Ordinance No. 18429 vacating the above described alley was passed by the City Council. However, notice was not duly and regularly given of the hearing, and ordinance No. 18429 should be repealed and a new hear- ing called thereon, and now, therefore, THE CITY OF EUGENE DOES ORDAIN AS FOLI,OwS: Section 1. Ordinance zoo. 18429 passed by the City Council and approved by the Mayor on June 2'~, 1979 is hereby repealed. Section 2. The City Council of the City of Eugene herein inm- ates the vacation proceedings on its own authority without petition or consent of the property owners, except as provided by statute, of the above described alley. Ordinance - 1 18'~4l Section 3. A hearing shall be held upon the pxoposal to vacate the alley as herein provided, and the hearing shall be held on the 15th day of August, 1979, at noon, Pacific Daylight Time of said date, at the Council Chambers at City Hall, Eugene, oregon, at which time all persons will be heard upon objections or suggestions with regard to the vacation, and at said time the Council will provide for the vacation of the alley or deny such vacation, and in case the vacation is made, will provide and make provision for any damages sustained by local assessment. Section 4. The City Recorder is hereby directed to immediately publish once each week for four consecutive weeks in a newspaper pub- lisped in Eugene, Zane County,oregon, a notice of the proposed vaca- tion. The notice shall give a description of the area to be vacated as herein set out; state the date when this ordinance was passed, the name of any petitioners petitioning for the vacation, and the date when the petition, together with any objections or remonstrances which may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing will be heard and considered. Section 5. The City Recorder shall forthwith and within five days after the first publication of the notice post, or cause to be posted, at ar near each end of the proposed vacation a copy of the foregoing, which shall be headed "~~otice of Alley Vacation", and which notice shall be posted in at least two conspicuous places in or on the area proposed to be ~racated.
