An Ordinance repealing Drdi~nance No. 18413 and initiating the
vacation of the following described street, slope and public utility
easements, to-wit:
As described on Exhibit "A" attached hereto, and
by this reference incorporated herein :Anderson Sv 79--2 ~
On the 3~Oth day of May, 1979, the City Council of the City of
Eugene passed Ordinance No, 18413 setting a hearing to be held on
the llth day of July, 1979, at the Council Chambers at City Hall,
Eugene, Oregon, at which time and place protests and remonstrances
could be heard as to the proposed vacation of the above described
street, slope and public utility easements.
However, notice was not duly and regularly given of the hearing,
and ordinance No. 18413 should be repealed and a new hearing called
thereon, and now, therefore,
THE CITY CF EUGENE DoE5 ORDAIN A,S FOLLOWS.
Section 1. Ordinance No. 18413 passed by the Ca,ty Council and
approved by the Mayor an May 3D, 1979 is hereby repealed.
Section 2. The City Council of the City of Eugene herein ini-
ates the vacation proceedings on its own authority without petition
or consent of the property owners, except as provided by statute, of
the above described street, slope and public utility easements.
Section 3. A hearing shall be held upon the proposal to vacate
the street, slope and public utility easements as herein provided,
and the hearing shall be held on the 15th day of August, 1979, at
noon, Pacific Daylight Time of said date, at the Council Chambers
at City Hall, Eugene, Oregon, at which tame all persons will be heard

upon objections or suggestions with regard to the vacation, and at
said time the Council will provide for the vacation ar deny such
vacation, and in case the vacation is made, will provide and make
provision far any damages sustained by local assessment.
Section 4. The City Recorder is hereby directed to immediately
publish once each week for four consecutive weeks in a newspaper pub-
lished in Eugene, Lane County,Oregan, a notice of the proposed vaca-
tion. The notice shall give a description of the area to be vacated
as herein set out; state the date when this ordinance was passed, the
name of any petitioners petitioning for the vacation, and the date
when the petition, together with any objections or remonstrances which
may be made in writing and filed with the Recorder af~the City of
Eugene prior to the date of the hearing wi~.~. be heard and considered.
Section 5. The City Recorder shall forthw~.th and within five
days after the first publication of the notice post, or cause to be
posted, at or near each end of the prgpos.ed vacation a copy of the
foregoing, which shall be headed ~`~otice of Street, Slope.a,nd Public
Utility vacatians~f and which notice sha~,l be posted in at least two
conspicuous places in ar on the area proposed to be vacated.
The pasting and the first day of publication of the notice shall
be not less than twenty--eight ~28~ days before the time set for hearing.
