HomeMy WebLinkAboutOrdinance No. 18447ORDINANCE NO. ~y AN ORDINANCE CONCERNING THE ELECT~ZCAL CODE; AMENDING SECTIONS 5.075, 8.080, 8ROS5, 8.090, 8.095, $.105, S.11D, $.120, $.125, 8.130, AND $.135 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE. DOES ORDAIN AS FOLLOWS: Section 1. Section 8.475 of the Eugene Code, 1971, is hereby amended to provide: 8.075 Electrical Speci,alt~r _Co~e. Ali, e~.ectrical installations - in the city shall conform to the standards and require- ments of the State of Oregon Electrical Specialty Code, as adopted by the State of Oregon Department of Commerce pursuant to ORS 456.?50 to oR5 456.885, and as on file in triplicate in the office of the finance officer . The State of Oregon Elec- trical Specialty Code, together with sections 5.075 to 8.135 of the Eugene Code, 1971, sha1,1, constitute the electrical specialty code of the city. In sections 8.080 to 8.135, the phrase "this code refers to this electrical specialty code. Section___2. Section 8.080 of the Eugene Code, 1971,. is hereby amended to provide: 8.0 S 0 Electrical Inspectors . The bu~.lding official shal l designate personnel to be known as electrical inspectors and shall be responsible for the enforcement of this code. Section 3. Section 8.085 of the Eugene Code, 1971, is hereby amended to provide: 8.085 Enforcement. In the event an electrical inspector shall, have knowledge of a violation of this code by any person, he may, if he deems~it advisable, stop all further work on the installation and refuse to permit the electrical contractor or other person to proceed further with the electrical installation until the violation has been corrected. If the person is aggrieved by the ruling he may appeal to the electrical board from the ruling of the electrical, inspector. No further work shall be done on the electrical installation or repair until the appeal is heard by the electrical board. Section 4. Section 5.090 of the Eugene Code, 1971, is hereby amended to provide: ordinance - l isw~, 8.090 Inspections - New Work. The electrical inspector shall be notified by the person doing the work before any electrical installation is concealed, and for a final inspec- tion upon completion of any electrical ,installation. The elec- trical inspector shall inspect the same after receipt of notice and, if the work conforms in all respects to the provi- sions of this chapter, he shall attach a notice of approval. No electrical wiring shall be cQVered or concealed until 48 hours have expired after notice to inspect has been received ar until the inspector has given approval, whichever is earlier. Should the inspector find that the electrical installation is not in accordance with the provisions of this code, he shall give notice in writing to the person engaged in the work, within 15 days after notification or within such further reasonable time as may upon request be prescribed, the e~.ectrical installation shall be altered or removed as the case may requ~,re, and necessary changes shah be made so that the electrical installation shall fully comply with the provisions of this code. Section 5. Section 8.095 of the Eugene Cade, 1971, is hereby amended to provide: 8.095 Inspections - ~einspection of Exista~ng Installations. The electrical inspector is hereby empowered to rein- spect all electrical installations coming within the scope of this code. When any electrical installation is found to be dan- gerous ar unsafe, the person owning, using or operating the same shall be notified and shall make the necessary repairs or changes required to place the electrical insta~.lation in a safe condi- tion; such work to be completed within 15 days after natif ication or within such further reasonable time as may upon request be prescribed. Section 6. Section 8.105 of the Eugene Code, 1971, is hereby amended to provide: 5.105 Final Ins ection and A rova~, of Service. {.1~ The electrical contractor performing an electrical installation shall notify the electrical ~.nspector of its com- pletion and request a final inspection before the installation is put into permanent service and prior to occupancy of the building in accordance with section 306 of the Structural Spe- cialty Code. Should the electrical installation be disapproved, the building shall not be occupied and~the electrical inspector may order the electrical service disconnected in accordance with section $.100. {2~ The electrical inspector shall, at the time of final inspection or approval of e~.ectrical service when the electrical installation is completed and found to comply with this code, install a label upon the electrical service panel Ordinance - 2 18µ~+~ which shall state as follows: "Notice: The electrical service in this building is adequate to serve the electrical equipment in- stalled when built. Tt does not necessarily pro- vide far future expansion or installation of addi- tional electrical appliances or equipment. Any changes in this equipment should be made only after consultation with a qualified person A permit is required for any electrical work. Do not remove this label." The electrical inspector shill s.~gn and date this label. Section 7. Section 8.14 of the Eugene Code, 1971, is hereby amended to provide: 5.110 Temporary_Use of Electrical Current. when an urgent necessity for the use of electrical energy in an elec- trical installation is known to exist, the electrical inspector may grant permission for the temporary use of electrical energy to any electrical,installation~ which is in such condition that electrical energy may safe~.y be used therein without danger to life or property. Permission may be obtained for the temporary use of electrical energy during the construction or alteration of any building by making a prior written request to the build-~ ing official or~his designee.. The written request shall: ~,a~ Indicate the approximate length of time far which electrical current is needed, ~.b~ Include a statement that compliance with section S.laS will be assured prior to occupancy of the building, and ~c~ ~e endorsed ~y the person doing the work and by the person in charge of the property as defined in this Chapter. Section 8. Section 8.124 of the Eugene Code, 1971, is hereby amended to provide: 8.120 Cit Not Ziable For Dama es. This code shall not be construed to relieve or lessen the responsibility of any person owning, operating or insta~,ling any electrical in- stallation for. damages to anyone injured by any defect there- in, nor shall the city or any agent thereof be held to assume any such liability by~reason of inspection authorized herein or the certificate of inspection issued by the electrical inspector. Section 9. Section 8.125 0~ the Eugene Code, 1971, is hereby amended to provide: ordinance -- 3 IS~H7 8.125 Permits . ~ 1 } R~uired; Exceptions . A permit shall be secured from the city before performing any electrical installation cov- ered by this coder provided, however, that maintenance work noted in subsection ~2~ below, and the installation of meters, service wires and exceptions as noted in subsection ~3} below may be installed, altered or repaired without a permit. ~2} Maintenance .permits. A person holding an elec- trical maintenance license shall keep a written record of all electrical installations performed in or about the property under his jurisdiction and shall, at the end of every 3d days or oftener, obtain the required permits to cover such electrical installations; provided however, that where electrical wiring is to be concealed, the electrical inspector shall be notified for inspection before such work is concealed. ~.3} Minor electrical work. Permits will not be re- quired for minor repair work, such as repairing flush and snap switches, replacing fuses, rep~.acing lamp sockets and receptacles, taping bare joints and repairing drop cords, nor for experiment- al electrical work of a temporary nature in testing laboratories of electrical shr~ps, educational institutions and similar uses. ~_4 } Applicatitin far_ permit. To obtain a permit the applicant sha11 first file an application therefor in writing on a form furnished by the building official for that purpose. The application shall: ~a} Identify and describe the work to be covered by the permit for which the application is made; {b} Describe the land on which the proposed work is to be done, by lot, block, tract, and house and street address, or similar description that will readily identify and definitely locate the proposed building or work; ~c} Indicate the use or occupancy for which. the proposed work is intended; ~~~ Be accompanied by plans and specifications as required ~in subsection ~:6 } of this section; Vie} Be signed by the owner of the land or building or by his authorized agent, whom the build- ing official may require to submit evidence of the authority; and 4f} Give such other information as the build- ing official. may reasonably require. ~5 }. Duration, of permits . Every permit issued under the provisions of this code shall expire by limitata,on and be- come null and void if the work au~thora.zed by the permit is not commenced within 12~ days from the date of issuance of the per- mit, or if the work authorized by the permit is suspended or abandoned f or ~ a period of ~, Z 0 days at any time after the work is commenced. Before the work may be recommenced, a new permit must be obtained. ~ 6 } Plans and spec,if ications . Every person making application for a permit on any structure, other than a single and two family dwelling or accessory building thereto, sha11 Ordinance - 4 18'W7 file with the building department proper electrical plans, specifications and schedules as may be necessary to determine whether the installation as described wi~,l conform to the re- quirements of this chapter. The plans and specifications sub- mitted must be complete and shall show, among other details, the following: ~a} Size of wares and conduit for main ser- vices and approximate vocation in the building of its service equipment and meter. fib} fain service layout, size, number of main switches and similar information. ~c~ I~ocatign ~f d~.str~,but~,on panels and size of branch circuits and condua,t feeding distribution cabinets. ~~} Circuits feeding from distribution panels, size of wires fox' each circuit, size and number of wires in each conduit and the load of each circuit, ~e~ ~,ocation of ~i~ed electrical equipment loads with wattage or horsepower. ~.f} Location of~individual controls, switches and .similar information. ~.g} A key to the symbols used shall accompany all plans. If mains, feeders, branch circuits and distribution panels are shown on the plans, it is de- suable that they be designated by letters or numbers. ~7} Permit Fees. Permit fees shall be as established by resolution of the council.. ~S} Permit d~eni~als. Failure on the part of any licensee to correct any defect, error or deficiency in any work within 15 calendar days after notification thereof in writing, or such further time as may upon request be prescribed, shall automatically and without further notice stop the issuance of .permits to the licensee until the corrections have been made, inspected and approved. The electrical inspector shall be promptly notified upon correction of any defect, error or de_ ficiency. The electrical, inspector is without discretion in the application of the above rules unless request is made for further time within 15 days after notification of any defect, error or deficiency. Section 10. Section 5.130 of the Euge~,e Code, 191, a~s hereby amended to provide: 8.130 Electrical Board. ~l} Creation. There is hereby created an electrical board. The board shah consist of three members: an electri- cal contractor, an electrical eng~,neer and a journeyman elec-~ trician. Board members shall be nominated by the mayor and shall be appointed by .the council. The electrical inspector shall be an e.~ officio member of and shall act as secretary to the board. ordinance - 5 -s~w~ ~2 ~ Terms and removal of members . The members of the board shall hold office for three years following appointment or until a successor has been appointed. One member shall be appointed each year. Upon expiration of a term of any member, he or she may, at the pleasure of the council, be reappointed to serve additional terms. The council shall have the power to remove any member of the board at any time for malfeasance in office, incapacity or neglect of duty.. ~..3~ Duties ge~ner~lly. The duties of .the board,. in addi- tion to other duties that may be specified in this code, shall be to hear complaints against licensees under this chapter. The board shall have the power to suspend or revoke any electrical license granted as provided in chapter 3 of the Eugene Code, 1971. 4.4~ ~ Appeals to board. The owner of a building or struc- Iliil• iliil~•Ilil ture, or any other person, may appeal to the board from the deci- sion of the electrical inspector refusing to grant a modifica- tion of the provisions of this code covering the manner of con- struction or materials to be used in an electrical installation. Application for appeal may be made when it is claimed that the true intent of this code has been incorrectly interpreted, the provisions of this code do not fully apply or an equally good ar better material or method of electrical, installation is proposed. ~_5} procedures of board. All hearings shall be public, and the appel~.ant, his representatives, the electrical inspector and any other person whose interests may be affected by the matter of appeal shall be given an opportunity to be heard. A majority of the board shal~.~constitute a quorum. The baard shall affirm, modify or reverse the decision of the electrical inspector by concurring vote of two members. The board shall adopt reasonable rules and regulations for conducting its in- vestigations and shall render all decisions and findings in writ- ing to the electrical inspector with a copy to the appellant. Section 11. Section 5.135 of the Eugene Code, 1971, is hereby amended to provide: 5.135 Standards for, and Identification af, Materials, Appli- ances and Equipment. ~. I , ~{ 1 ~ Except as the -State of Oregon Electrical Specialty Code adapted in section 8.D75 prescribes to the contrary, mater- ials, appliances and equipment incorporated into electrical in- stallations subject to this code, or sold or offered for sale for that purpose, shall bear the registered label or listing mark of a national~.y recognised electrical--safety-testing lab- oratory or other electrical--safety-testing laboratory that the building off icia~. finds to be as rigorous and reliable in its electrical-safety testing as any such nationally recognised laboratory. Any such finding shah. have legal effect only after the building official states the finding in writing and files it with the finance officer, where it shall be available for public inspection during regular office hours. Before making the finding the building off i~ial shall give the public 34 days' Ordinance - 6 18~+~+'t advance notice posted at the city hall, and send electricians licensed by the city 3~ days' advance notice by first-class mail that he intends so tc~ state and file the finding, within 30 days after the finding is so stated and filed, any person aggrieved by it may xequest the build~.ng official to reconsider it. The building official, shale,. then set a time and place in the city for a public hearing on the finding, and shall give the aggrieved person, by first-class mail, and the public, by posting at the city hall, 3~ days' advance notice of the hear- ing. At the hearing any interested person may present informa- tion and argument regarding the finding, within 30 days after the hearing the bui~.ding off icial shall restate the finding., modify it~or rescind it, state in writing his reasons for doing so, and file the restatement, modification or rescission with the finance officer. legal effect of the restatement, modifi- cation or rescission shall begin as soon as it is so filed. ~.?~ Used materials,~appliances and equipment that have been taken out of use for electrical, purposes shall, before again being put to such use, be reconditioned ar remodeled to whatever extent is necessary to bring them into compliance with this code. Section l2. That the pxovisions contained herein concern the public welfare and safety and thexef ore, an emergency is hereby de- clared to exist, and this ordinance shall become effective~immediate- ly upon its passage by the City Council and approval by the Mayor.
