AN ORDINANCE CONCERNING THE MECHANICAL SPECIALTY
CQDE; AMENDING SECTIONS 8.495 AND 8.540 OF THE
EUGENE CODE, 1971; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FQLLOWS:
Section 1. Section 5.495 of the Eugene Code, 1971, is hereby
amended to provide:
8.495 Mechanical_ Speci.alt~_Cade. The fo~,lowing codes are
hereby adopted as the Mechanical Specialty Code of the
city
~.a7 The State of Oregon Mechanical Specialty Cade,
excepting Chapters 1, ~ and 3 thereof, as adopted by the
Director of the Oregon Department of Commerce pursuant
to ORS 456.750 to 456.885.
fib} Chapters. 1, ~ and 3, and chapter 22 of Appen-
dix B, of the 1976 Edition of the Uniform Mechanical
Code, published and copyrighted in 1976 by the Inter-
national Conference of Building Officials, as amended
by section 8.500 of the Eugene Code, 1971.
Copies of each code shall be filed in triplicate in the office
of the finance officer.
Section 2. Section 8.500 of the Eugene Code, 1971, is hereby
amended to provide:

and 3 ~-of the, 1976 Edition of the Uniform Mechanical Code
are hereby amended as follows:

building or structure, o~r~~any other person, may
appeal to the board of appeals from a decision of
the building of f ic,ial refusing to~ grant a madif i-
cation of the provisions of the mechanical code
covering the suitability of alternate materials,
types of construction and installation, or to pro-
vide for reasonable interpretations of the provi-
sions of this Cade. An application far appeal
may be made when it is claimed that the true in-
tent of the mechanical specialty code has been
incorrectly interpreted, the provisions of the
mechanical, specialty code do not fully apply, or
an equally good or better material, method of con-
struction or installation is proposed.

~b~ A lication for license. The board of
appeals shall qualify applicants for gas piping
or venting licenses by conducting examinations.
The examinations shall be designed to determine
a license applicant's knowledge of the standards
for safe and satisfactory installation, the use
of gas burning equipment and piping systems and
competency tv perform such installations. The board
shall prepare written and oral examinations to
determine the qualifications and competency of all
. pexsons making appl,icativns for a gas fitter' s
license end shall adopt rules and regulations per-
taining to the giving of the examinations. The
examination papers sha,~.l be filed as official re-
cords of the board.
~C ~ N~en~bership o board of ap eals . The board
shall consist of five members appointed by the mayor,
one member to be appointed initially for five years,
one for four years , cane ~ f or three years , one for
two years and one to serve one year. ,Thereafter
each new member shall serve for five years or until
his or her successor has been appointed. The
building official ox his designee shall be an ex
officio member of the board but shall have no vote.
The building official or his designee shall act as
secretary to the board.
~d} Qualifications of board. members. Each
board member shall be a l~,censed professional mech-
anical engineer, a ~.icensed architect or other
person.q~alified by experience and training to pass
on matters pertaining to mechanical systems and
mechanical equipment of buildings. At no time
shall theee be more than two board members from
the same profession or business. At least one board
member shall be a licensed professional mechanical
engineer and one member shall be a licensed archi-~
test with mechanical equipment and mechanical
systems experience.
Vie} Procedures of the board. All hearings
shall be pub~,ic, and the appellant or license appli-
cant, his representatives, the building official
and any other person whose interests may be affected
by the mattex an appeal or by the license applica-
tion shall be given an apportun.ity to be heard.
The board shall, affirm, modify or reverse the deci-
sion Qf the building official by a concurring vote
of three members. The board shall adopt reasonable
rules and regulations and shall render all deci-
sions and findings in writing to the license appli-
cant or appellant.
~c~ Section 3Q4 is amended to read:
Section ~3~~4, Permit Fees. Any person apply-
ing for a permit required by this code shall, at the
time of filing an application, pay a fee as established

by resolution of the counc~.l.
Section 3. That the pro~`isions contained herein affect the
public welfare and safety and therefore, an emergency is hereby de~-
Glared to exist, and this ordinance sha1~. become effective immedi-
ately upon its passage by the City Council, and approval by the Mayor.
