J $~5~ AN ORDINANCE CONCERNING THE MASONRY CpNTRACTOHS' CODE ; AN~ENDTNG SECTLONS 8 , 4 ~, 5 r $ , 4 z 0 , $ . 4 2 5 AND 8.445 OF THE E~GEN'E CODE, 1971; REPEALING SECTION 8.435 OF THAT CODE; AND DECLARING AN EMERGENCY. THE CITY pF EUGENE. DOES ORDAIN AS FOLLOWS: Section 1. Sections 8.415, 8,420 and $.425 of the Eugene Code, 1971, are hereby amended to provide: 5.415 Title and Definition. ~ l ~ Sections 8.415 to S 4 4 45 shale. be known as the Masonry Contractors' Code. t2~ Masonry contractor. A person who engages in the masonry construction business, including, but not limited to, the laying of brick, cinder blocks, concrete blocks, pumice blocks or any other masonry equivalent which requires the setting of individual pieces with mortar. 8.420 Exemptions. A person constructing, altering, removing or repairing any structure for his own use~or occupancy, and who shall not have altered, constructed or repaired any other structure within a sip--month period, shall be exempt from the requirements of this code, except that a permit shall be required. 8.425 Masonr Eoard ~ Creation, Duties, Procedures. ~l~ There is hereby crested a masonry board which shall consist of three members appointed by the mayor, one member to be appointed initially for three .years, one for two years, one for one year and, thereafter, each new member to serve far three years or until his or her successor has been appointed. The building official shall be an ex officio board member and shall act as secretary to the board. Each member shall be a licensed masonry contractor or supervisor, a licensed professional en~- gineer, architect, superintendent of building construction or building contractor qualified by experience and training to pass on matters pertaining to masonry construction. At no time shall there be two board members from the same profession or business and at all times at Least one board member shall be an architect or engineer. ~2~ The duties of the board shall be to pass on the applications of masonry contractors and masonry foremen far licenses under the Eugene Code, 1971, and to hear complaints against licensees. Section 8.435 of the Eugene Code, 1971, is hereby repealed. Section 3. Section 5.445 of the Eugene Code, x,971, .~s hereby amended to provide: 5.445 Enforcement and Tns ections, ~1} The building official a.s charged wa.th the enforce- ment of this code and shall inspect all masonry work performed within the city. He may approve or condemn masonry work in whole or in part. He shall, condemn and reject all work done or being done, ox materials used or being used, which do not in all respects conform to the provisions of this code and shall order such changes in workmanship or materials as will make the same conform to the requirements of Chapter S of the Eugene Cade, 1971, such changes to be performed and accomplished within a reasonable time.. ~~~ A masonry contractor why fails or refuses to comply with the lawful order of the bui~.ding official to perform masonry work in accordance with this code and the provisions of the Structural Specialty Code shall be subject to prosecution in the municipal court. Section 4. That the prov~,sions contained herein concern the public welfare and safety and therefore, an emergency .is hereby de- Glared to exist, and this ordinance shall beco~e effective immediate-~ ly upon its passage by the City Council and approval by the Mayor.
