An Ordinance repealing Ordinance No. 18417 and initiating
the vacation of the following described Public Utility Easement,
to--wit:
Beginning at a point being South 89°15' East 7.00
feet from the Northwest corner of Lot 3, BLACKSTONE,
as platted and recorded in File 73, Slide 185, Lane
County Oregon Plat Records; thence South 89°15' East
79.81 feet; thence South 0 ° 28' 10" West 7.00 feet;
thence North 89°15' West 79.79 feet; thence North
0°18'40" East 7.00 feet to the Point of Beginning,
in Lane County, Oregon. Hughes Ev 79~-4.}
On June 13, 1979, by Ordinance No. 18417, the City Council
initiated the vacation of the above described Public Utility
Easement and directed that a hearing be held thereon on the 25th
day of July, 1979. The hearing was not held on July 25, 1979,
and Ordinance 18417 should be repealed and a new hearing scheduled
as hereinafter provided.
NOW, THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 18417 adopted and approved on June 13,
1979, is hereby repealed.
Section 2. The City Council of the City of Eugene herein
initiates the vacation proceedings on its own authority without
petition or consent of the property owners, except as provided by
statute, of the above described Public Utility Easement.
Section 3. A hearing shall be held upon the proposal to va-

ing shall be held on the 3rd day of October, 1979, at noon, Pacific
Daylight Savings Time of said date, at the Council Chambers at City

Hall, Eugene, Oregon at which time all persons will be heard
upon objections or suggestions with regard to the vacation,
and at said tine the Council will provide for the vacation of
the Public Utility Easement or deny such vacation, and in case
the vacation is made, will provide. and make provision for any
damages sustained by local assessment
Section 4. The City Recorder is hereby directed to immedi-
ately publish once each week for four consecutive weeks in a
newspaper published in Eugene, Lane County, Oregon, notice of the
proposed vacation. The notice shall give a description of the
area to be vacated as herein .set outs state the date when this
ordinance was passed, the name of any petitioners petitioning for
the vacation, and the date when the petition, together with any
objections or remonstrances which may be made in writing and
filed with the Recorder of the City of Eugene prior to the date
of the hearing, will be heard and considered.
Section 5. The City Recorder shall forthwith and within
five days after the first publication of the notice post or cause
to be posted, at or near each end of the proposed vacation a copy
of the foregoing, which shall be headed "Notice of Public Utility
Easement Vacation," and which notice shall be posted in at least
two conspicuous places in or on the area proposed to be vacated.
The posting and the first day of publication of the notice
shall be not less than. twenty-eight ~~5~ days before the time set
for hearing.

NOTICE IS HEREBY GIVEN that at a meeting of the City Council
of the City of Eugene, held at the Council Chamber at City Hall,
Eugene, Oregon, on the 27th day of August, 1979, .there was passed
by the City Council and approved by the Mayor of the City of
Eugene, Lane County, Oregon, Ordinances setting hearings to be
held on the 3rd day of October, 1979, at noon, Pacific Daylight
Savings Time, at the Council Chamber at City Hall, Eugene
Oregon, for the purpose of~hearing remonstrances and protests
against the vacations by ordinance of the City Council of the

The City Council will consider and act upon the proposed
vacations on the 3rd day of October, 1979, at noon, Pacific Daylight
Savings Time, at the Council Chamber at City Hall, Eugene, Oregon,

and will consider Ordinances vacating the above. All persons
having objections. thereto or remonstrances or protests are hereby
notified to present the same to the City. Council in writing prior
to said hearing or at said time and place.
