An Ordinance repealing Ordinance No. 18418 and initiating
the vacation of the fallowing described Public Utility Easement,
to-wits
BEGINNING at the initial point of LYNDON HEIGHTS,
as platted and recorded in File ?3, Slide 17~,
Lane County, Oregon Plat Records, Lane County,
Oregon; run thence South 59°37' west 15,Q feet
along the South line of Lot 7 to the TRUE POINT
OF BEGINNING; thence North 30°23' West 7.D feet
thence South 59°37' west 9S.?~ feet; thence
South 34°23' East 14.0 feet; thence North 59°37'
East 98,7Q feet; thence North 30°23' West 7.8
feet to the True Point of Beginning. Lyndon

On June 13, 1979, by Ordinance No, 1$418, the City Council
initiated the vacation of the above described Public Utility
Easement and directed that a hearing be held thereon on the
25th day of July, 1979. The hearing was not held on July 25,
1979, and Ordinance 18418 should be repealed and a new hearing
scheduled as hereinafter provided.
NOW, THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 18415 adopted and approved on
June 13, 1979, is hereby repealed.
Section 2. The City Council of the City of Eugene herein
initiates the vacation proceedings on its own authority without
petition or consent of the property owners, except as provided by
statute, of the above described Public Utility Easement.
Section 3. A hearing shall be held upon the proposal to
vacate the Public Utility Easement as herein provided, and the

hearing shall be held on the 3rd. day of October, 1979, at noon
Pacific Daylight Savings Time of said date, at the Council Chambers
at City Hall, Eugene, Oregon, at which time all persons will be
heard upon objections or suggestions with regard to the vacation
and at said time the Council will provide for the vacation of the
Public Utility Easement or deny such vacation, and in case the
vacation is made, will provide and make provision for an dama es

sustained by local assessment.
Section 4. The City Recorder is hereby directed to immedi-
ately publish once each week for four consecutive weeks in a
newspaper published in Eugene, Lane County, Oregon, notice of the
proposed vacation, The notice shall give a description of the
area to be vacated as herein set out; state the date when this
ordinance was passed, the name of any petitioners petitionin for

the vacation, and the date when the petitian~ together with an

objections or remonstrances which may be made in writin and

filed with the Recorder of the City of Eugene prior to the date
of the hearing, will be heard and considered.
Section 5. The City Recorder shall forthwith and within
five days after the first publication of the notice post or cause
to be posted, at or near each end of the proposed vacation a co

of the foregoing, which shall be headed "Notice of Public Utilit

Easement vacation," and which notice shall be posted in at least
two conspicuous places in or on the area proposed to be vacated.
The posting and the first day of publication of the notice
shall be not less than twenty-eight ~~87 days before the time set

NOTICE IS HEREBY GI~IEN that at a meeting of the City Council
of the City of Eugene, held at .the Cauncil~Chamber at City Hall,
Eugene, Oregon, on the ..27th day of August; 1979, .there was passed
by the City Council and approved by the Mayor of the City of
Eugene, Lane County, Oregon, Ordinances setting hearings to be
held on the 3rd day of October, 1979, at noon, Pacific Daylight
Savings Time, at the Council Chamber at City Hall, Eugene,
Oregon, for the purpose of~hearing remonstrances and protests
against the vacations by ordinance of the City Council of the
