Pursuant td the provisions of ORS 227,215, Section 9.278 and 9.68 .. througi~ 9. ~S~ of the Eugene Code, 1971, the City Council has the authority and responsibility, subject to the limi rations contained. therein, to ehan e g .the zoning classification of property within the City of Eugene; Based upon the report of the P1 anni ng Commission, the mat~ri al s trans . matted therewi ~.h, and the ev ~dence presented before the Punning Commission and this. Counci ~ , the raquest for zone change cl assi fi cati.on is i n conformance with the General Plan; there is a publ is need for the chan e in zone and the 9 public need can best be served by changing the classification of the property; NOW, THEREFORE, Based upon the foregoing, the City Council hereby adapts as its own the specific afrirmative findings contained in the Punning De artment staff notes p of July 2~, 1979, and the Planning Comm7ss~on minutes of July 24, 119, for the reasons set forth therein, and ~ . THE .CITY 4F EUGENE DOES ORDAIN AS FOLLOWS: Section 1. As provided by Section 9.278 of the Eugene Code, 1911, the zoning map and the zoning ordnance schedule of district changes are hereby amended to reflect the fol 1 owi ng change of zone: Tax Lvt 12a1~-Assessor's Map 11~04~35 as more particularly described on the attached Exhibit "A", located east of Bailey Hill Road and north of West 11th Avenue: Change of zone from RA Suburban Residential District and M~-2 Light Industrial District to M~1/SR Limited Industrial District with Site .,Review procedures, said site review procedures addressing concerns as set forth in Exhibit "B," attached. . Section 2, The Planning Director be, and he is hereby authorized and directed to cause the zoning map and .the zoning ordinance schedule of district changes attached to Chapter 9 of the Eugene Code, 1971, to show the foregain 9 ~ g5~ change of c~ assi fi cation of area and to Hate thereon .the rub e with respect to building in the appropriate ciassification.
