AN ORDIIr~ANCE CONCERNING THE PERFORMING ARTS
COMMISSION; ADD2T~G NEw SECTIONS 2.630, 2.632,
2.6.34 AND 2.636 TO THE EUGENE CODE, 1971;
.AMENDING SECTZdN 2.0.13 4F THAT CODE; AND DE-
CLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The following new sections are hereby added to the
Eugene Code, 1971, to provide:
2.6 3 0 Perf ormin Arts Camn~i~s sion ~- Created. A perf orrning
arts commission is established to serve as an advisory
body to the council ~n policy matters and to the city manager
and performing arts director on operational matters relating
to the Eugene Perforrr~ng Arts Center for the city.
2.632 Performin Arts Commission ~ Duties.
~1} The commission shall consider, and when a ro-

priate, submit by res~lut~on a.ts recommendations on policy to
the council and on aperati~nal matters to the city manager and
performing arts center director. Recommendations of the com-
mission may include its consideration of such matters as:
~a} whether the center is meeting the needs of
the community to the degree possible,~and the commis-
sion shall monitor com~nity opinion in arriving at
its evaluations;
[b} Lang-range plans for the operational use of
the center;
~:c} Processes concerning types of tenant leases,
subscription programs, audience development programs,
and other similar long-term projects as may come before
the board;
~:d}. Coordination of center activities with other
agencies within and outside the j~.urisdictian of the city
in a manner that will minimize conflicts and duplication;
~:~} Coordination with other groups and organiza-~
Lions in the raising and receipt of private donations
and funding far the center's development and operation.
~2} The Commission shall consider and submit by resole--
tian, recommendations on policy to the council and on operational
matters to the city manager and performing arts director as
follows:
~~~a} An annual recommendation to the budget com-
mittee of the city. The recommendation shall be spe-

recommendation the budgetary effects of commission

ing surplus ar deficiency experienced in the immediately
preceding fiscal year and anticipated in the upcoming
fiscal year.

a diverse and wide range of type of performances that

time, rules, regulations and operating policies con-
cerning operation of the center.
~e~ Make an annual, report to the council of the
acti~rities ar~d financial condition of the center,
which information shall be made available to other com-
missians and officials of the city as is necessary or
desirable.

~l~ The commission shall consist of nine members nomi-
nated by the mayor and appointed by the co~,ncil. The city mana-
ger shall serve as an e~ officio member of the commission..
~2~ Except as provided herein for initial cornn~ission
members, the term of office far each member, exclusive of ex-
of f icio member, shall be for four years . The term of office of
initial commission members shall be:
~.a} Three members shall be appointed,ta serve
a four year term,
~.b} Three members shall be appointed to serve
a three year team, and
~~c Three members shall be appointed to serve a
two year term,
~3} vacancies in office shall be filled in the same
manner as original appointments to the commission,
~4~_ A commission member may be remoYed from office by
an offirmatwe vote of the~co~uncil at any time prior to the ex-
piration of his or her terra.

~l~ The officers of the caxr~mssion shall be a president
and a vice-president elected by the znen~bers of the car mission,
Initial officers shall sere for terms of three years or until a
successor is appointed or elected for the office. Subsequent
officers shall serve for terms of tiro years, or until a successor
is appointed or elected for the office. The president shall pre-
side over meetings of the comm%ssian and shall have the right to

vote. The vice-president shall perform the duties of the presi-
dent in the absence or disability o~ the president.
~:2~ The commission shall hold regular meetings at least
once a month, and at such other times as may be necessary to
properly perform its duties.
~_3~ The term of a commission member who fails to attend
two consecutive. regular ;meetings shall automatically be termi-
nated unless his or her absence has been excused by the presi-
dent or by ~~rote of the com7mi~s~sion.
~4 } The commission shall adopt a plan of internal or--
ganizatian and rules of procedure necessary for the conduct of
its business, consistent with state law, the charter, code,
ordinances and resolutions of the city, which shall be submitted
to ~~he council and become effective upon council approval thereof.
Meetings and other activities of the commission, its officers
and committees, shall conform to the rules, state statutes,
charter provisions, code, ordinances and resolutions of the city,
Section 3. The table of boards, co~mi.ssions and committees of
the city set forth in Section 2.0.1.3 0~ the Eugene Code, 1971, is
hereby amended by inserting in alphabetical. order therein;

Section 4, That the provi~s.ions G~ntained herein concern the
public welfare and therefore, an emergency is hereby declared to
exist, and this ordinance shall become e,~fective immediately upon
its passage by the city council and approval by the Mayor.
