HomeMy WebLinkAboutOrdinance No. 18509ORDINANCE N0. g~~ An Ordinance vacating the following described public utility easement, to-wit: Beginning at a point being South 89°15' East 7.00 feet from the Northwest corner of Lot 3, BLACKSTONE, as platted and recorded in File 73, Slide 185, Lane County Oregon Plat Records; thence South 89°15' East 79.81 feet; thence South 0°28'10" West 7.00 feet; thence North 89°15' West 79.79 feet; thence North 0°l8'40" East 7.00 feet to the Point of Beginning, in Lane County, Oregon. Hughes Ev 79~-4.~ On the 7th day of August, 1979, the City Council of the City of Eugene passed Ordinance No. 18490 setting a hearing to be~ held on the 3rd day of October, 1979, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of the above described public utility easement. Notice was duly and regularly given of said hearing and a hearing was held pursuant to said Ordinance at the Council Chambers at City Hall, Eugene, Oregon, on the 3rd day of October, 1979, at noon, Pacific Daylight Savings Time, and at said time and place the Council heard all objections. All persons owning property abutting upon the public utility easement to be vacated have consented to the vacation and applied for the same, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and rsso9 posted as by law required and no valid objections have been made at the hearing or filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the public utility easement. Section 2. The hearing was held on the 3rd day of October, 1979, at noon, Pacific Daylight Savings Time, at the Council Chambers at City Hall, Eugene, Lane County, Oregon, and all matters necessary to be done in the premises have been duly and regularly completed. Section 3. The hereinabove described public utility easement is hereby vacated, and the public utility easement so vacated shall revert pursuant to the statutes of the State of Oregon. Section 4. The City Recorder is hereby directed to file a certified copy of this ordinance with the Recorder of Lane County, 0 regon, together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with the Lane County Assessor, and another certified copy shall be filed with the Lane County Surveyor, Passed by the City Council this ~f da of , 1979. y 1~ ~ rr `~~ r` .
