An Ordinance initiating the vacation of the fallowing described
street, to wit:
Described on Exhibit "A" attached hereto and
incorporated herein by reference. Spencer's

THE CITY 0~` EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene herein
initiates the vacation proceedings on its awn authority without
petition or consent of the property owners, except as provided by
statute, of the above described street.
Section 2. A hearing shall be held upon the proposal to
vacate the street as herein provided, and the hearing shall be
field on the 21st day of November, 1979, at noon, Pacific Standard
Time of said date, at the Council Chambers at City Hall, Eugene,
0 regon, at which time all persons will be heard upon objections
or suggestions with regard to the vacation, and at said time the
Council will provide for the vacation of the street or deny such
vacation, and in case the vacation is made, will provide and make
provision for any damages sustained by local assessment,
Section 3. The City Recorder is hereby directed to immedi-
ately publish once each week for four consecutive weeks in a
newspaper published in Eugene, Lane County, Oregon, notice of the
proposed vacation. The notice shall give a description of the
area to be vacated as herein set out; state the date when this
ordinance was passed, the name of any petitioners petitioning for

the vacation, and the date when the petition, together with any
objections or remonstrances which may be made in writing and
filed with the Recorder of the City of Eugene prior to the date
of the hearing, will be heard and considered.
Section 4. The City Recorder shall forthwith and within
five days after the first publication of the notice post ar cause
to be posted, at or near each end of the proposed vacation a copy
of the foregoing, which shall be headed "Notice of Street vacation,"
and which notice shall be posted in at least two conspicuous
places in or on the area proposed to be vacated.
The posting and the first day of publication of the notice
shall be not less than twenty-eight ~25~ days before the time set
for hearing.

NOTICE IS HEREBY GIVEN that at a meeting of the City Council
of the City of Eugene, held at the Council Chamber at City Hall,
Eugene, Oregon, on the 17th day of October, 1979, there were passed
by the City Council and approved by the Mayor of the City of Eugene,
Lane County, Oregon, ordinances setting hearings to be held on the
21st day of November, 1979, at .12:00 noon, Pacific Standard Time, at
the Council Chambers~at City Hall, Eugene, Oregon, for the purpose
of hearing remonstrances and protests against the vacations by ordinance
of the City Council of the following:
STREET VACATION
The East x,5,00 feet of the following described property:
Beginning at a point being at the Intersection of the centerline
of a 30 foot wide roadway with the South line of and North 88° 21'
45" East 35.42 feet from the Southwest corner of Lot 13, Humbolt,
as platted and recorded in File 72, Slide 8, Lane County Oregon
Plat Records, said point also being 1032.07 feet North and 1276.15
feet West of the Southeast career of Section 18, in Township l8
South, Range 3 West of the Willamette Meridian; thence along said
30 foot wide roadway centerline the following courses and distances:
South 10° 19' 54" West 308.03 feet; South 19° 36' 46" West 123.49
feet; and South 26° 53' 4?" West 149.99 feet; thence leaving said
roadway centerline South 89° 27' Ol" West 1110.75 feet to the
Easterly right-of--way line of Willamette Street; thence along said
right-of--way line along the~arc of a 643.11 foot radius curve left,
a distance of 59.15 feet the chard of which bears North 35° 58'
57" East 59.16 feet}; thence North 33° 20' 49" East 256.37 feet;
thence along the arc of a 921.47 foot radius curve left, a distance

Oregon Plat Records, when said 5.00 feet is measure perpendicular
to the east line of said Lot, in Eugene, Lane County, oregon.

The City Council will consider and act upon the proposed vacations
on the 2lst day of November, 1979, at 12:0o o'clock noon, Pacific
Standard Time, at the Council Chamber at City Hall, Eugene, Oregon, and
will consider Ordinances vacating the above. All persons having objec-
tions thereto or remonstrances. or protests are hereby notified to
present the same to the City Council in writing prior to said hearing
or at said time and .place, ..
