FOGELSON APPLICATION FOR MULTIPLE-UNIT PROPERTY TAx ExEMPTION, AND APPROVING APPLICATION No. MEP--79-1 THE CITY COUNCIL of THE CITY OF EUGENE FINDS THAT~- Jeremiah and, Susan S. Fogelson are the owners of real. property located at the northeast corner of Sth Avenue a,~~ Lawrence Street, more particularly described as Tax Lots 12000.,~2~00,12200. and X2300, Assessor's Map 17-03-31-1 2. They have submitted an application to the Department of Housing and Community Conservation ~HCC~ pursuant to the City's Multiple-Unit Rental Housing Property Tax Exemption Program, as adapted by Ordinance No. 18021 on July ll, 1977, with respect to the improvements to be constructed thereon. As required by the standards and guidelines attached as Exhibit "B" to Resolution No. 2711 adopted on July 11, 1977, establishing the procedures for review of such applications, as amended by Resolution No. 3165 on June 11, 1979, HCC has solicited recommendations and comments from the Project Advisory Committee. This Committee has indicated approval of the project. The City's Joint Housing Committee submitted its favorable recommendation on September 18, 1979. HCC has reviewed the applica-~ tion and supportive material and has adopted f findings.and recommended approval of the application, subject to certain conditions herein more specifically set forth. The project is an eligible structure as defined in the Stan- dards and Guidelines, and the applicant has agreed to include within the project design elements of benefit to the public as set forth below. The project is in conformance with all applicable local plans and planning regulations. The applicant has complied with all the provisions of the City's Standards and Guidelines. Now, therefore, based upon the findings set forth above, and the findings of HCC and the Project Advisory Committee, which are hereby incorporated by reference and adapted by the Council as additional findings, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The application of Jeremiah and Susan S. Fogelson for a property tax exemption under the City's Multiple-Unit Property Tax Exemption Program far improvements to be constructed upon the property located at the northeast corner of 8th Avenue and Lawrence Street, more particularly described as e Tax Lots 12000, ~ ~ 2~ 00, ~ 2200, and 12340 Ordinance - 1 18525 Assessor's Map 17-03-31--1 ~, in the City of Eugene, Lane County, Oregon, be and the same is hereby approved subject to the following conditions: 1. The project shall be completed before January 1, 1981. 2. The project shall be housing far lower-income elder- ly, for a period of ~4 years, financed through the State's Revenue Bonding Program, and subsidized through HUD's Section S Rental Subsidy Program 3. The building shall be accessible for both the physi- cally and visually impaired by means of ramps and an elevator, and 14 percent of the units specifically six units} are to be designed to comply with handicapped requirements tUBC; ANSI 117.1, 1.979; and HUD/MPS7. 4. The exterior decks and recreation meeting room, located on the fourth floor, shall be used by the tenants and the community as a neighborhood gathering place. This space shall be made available to community groups on a reser~ nation basis as agreed upon by the tenants for a period to extend beyond the period of exemption. 5. Areas shall be provided to allow tenants the ability to be outdoors, including an interior courtyard in the center of the building. Each unit shall have a private outdoor bal- cony. There shall be two exterior decks, located on the fourth floor roof adjacent. to the recreation room. 6. The applicant shall use good faith efforts to con- vince Lane Transit District to provide a bus shelter on west 8th Avenue. It is understood that seating adjacent to the project's 8th Avenue entrance will serve as bus seating on an interim basis until the bus shelter is constructed. 7. The building shall provide for the privacy and security of tenants and include: 7.1 the two main entrances shall be electronically locked at night, which each tenant can release through an intercom system, and 7.2 an emergency call system shall be installed in the bedrooms and bathrooms for notification to the manager in the event of an emergency. 8. The landscape design shall provide for neighborhood continuity of plant materials and seating areas as shown on the attached drawing and addendum 5p Exhibit A. 9. The parking which is accessible from the alley shall be screened by means of landscaping from the street to lessen its negative impact has shown on Exhibit A~. Section 2. That the improvements to be constructed upon the property described in Section l above are hereby declared exempt from local property taxation commencing January l of the year Ordinance - 2 1 %5zs following certification of completion and continuing for a continuous period of 10 years unless earlier terminated in accordance with the provisions of Section 2.947 of the Eugene Code, 1971. Section 3. That HCC is directed to forward a copy of this Ordinance to the applicant within 10 days from th~~date hereof, and to cause a copy of the Ordinance to be filed with the Lane County Assessor an or before January 1, 198.
