HomeMy WebLinkAboutOrdinance No. 18530ORDINANCE NO. r ~~~0 An Ordinance vacating the following described public utility easement, to-wit: Beginning at the most southerly Southwest, corner of Lot 24 of Skywaod, as platted and recorded in File 72, Slides 173 and 174, Lane County Oregon Plat Retards, thence South 76°2l'55" East 5.Q9 feet to the intersection of a 5 foot P~U.E, and the South edge of a 10 foot concrete bicycle and pedestrian walkway constructed in 1978, which is the True Point of Beginning of this description, thence along the South edge of said concrete walkway, South 87° 41'26" East 142.91 feet, thence leaving said South edge, South 89°47'24" West 143.55 feet to a point on the East boundary of said 5 foot P.U.E., thence along a 5l foot radius curve to the left 6.33 feet, with chord bearing North 6°5'46" East 6.33 feet to the True Point of Beginning, except therefrom any portion of that l4 foot P.U.E, running North and South through this description, that was dedicated in the Plat of Skywood all in Section 1, Township 18 South, Range 4 West of the Willamette Meridian. City of Eugene EV 79-3~ On the 17th day of October, 1979, the City Council of the City of Eugene passed Ordinance No. 18522, setting a hearing to be held on the 21st day of November, 1979, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of the above described public utility easement, Notice was duly and regularly given of said hearing and a hearing was held pursuant to said Ordinance at the Council Chambers at City Hall, Eugene, Oregon, on the 21st day of November, 1979, at 12:44 noon, Pacific Standard Time, and at said time and place the Council heard all objections. All persons owning property abutting upon the public utility Ordinance - 1 18530 easement to be vacated have consented to the vacation and applied for same, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and pasted as by law required and no valid objections have been made at the hearing or filed, The consent of the owners of the abutting prop- erty has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the public utility easement. Section 2, The hearing was held on the 21st day of November, 1979, at 12:0 noon, Pacific Standard Time, at the Council Chambers at City Hall, Eugene, Lane County, Oregon, and all matters necessary to be done in the premises have been duly and regularly completed. Section 3. The hereinabave described public utility easement is hereby vacated, and the public utility easement so vacated shall revert pursuant to the statutes of the State of Oregon. Section 4. The City Recorder is hereby directed to file a certified copy of this ordinance with ~~.the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certified copy of this ordinance shall be filed with the Lane County Assessor, and another certified copy shall be filed with the Lane County Surveyor.
