HomeMy WebLinkAboutOrdinance No. 18555ORDINANCE NO. _~~J'~ An Ordinance initiating the vacation of the following described bicycle/pedestrian path easement, to-wit: The southerly ten {l~~ feet of Lot 1a5, Oakway First Addition as platted and recorded in Book ~9, Page 31, Lane County Plat Records, in Section 2Q, Township l7 South, Range 3 west, Willamette Meridian, Eugene, Lane County, Oregon. RESERV2NG herein an easement on the ground, above the ground and beneath the ground for purposes of a public utility easement as established as a part of the plat of Fairway View PUD, and the right to enter thereon for purposes of construction, reconstruction and maintenance. REV 79-12 L. J'. Campbell THE CITY OF EUGENE DOE5 ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene herein ini- tiates the vacation proceedings on its own authority without peti- tion or consent of the property owners, except as provided by statute, of the above described bicycle/pedestrian path easement. Section 2. A hearing shall be held upon the proposal to vacate the bicycle/pedestrian path easement as herein provided, and the hearing shall be held on the 2Qth day of February, 1950, at noon Pacific Standard Time of said date, at the Council Chambers at City Hall, Eugene, Qregon, at which time all persons will be heard upon objections or suggestions with regard to the vacation, and at said time the Council will provide for the vacation of the bicycle/ pedestrian path easement or deny such vacation, and in case the vacation is made, will provide and make provision for any damages sustained by local assessments Section 3. The City Recorder is hereby directed to immediately publish once each week for four consecutive weeks in a newspaper pub- lished in Eugene, Lane County, Oregon,~notice of the proposed vaca- Ordinance - 1 r85ss tiara. The notice shall give a description of the area to be vacated as herein set out; state the date when this ordinance was passed, the name of any petitioners petitioning for the vacation, and the date when the petitions together with any objections or remonstrances which may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after the first publication of the notice post, or cause to be posted, at or near each end of .the proposed vacation a copy of the foregoing, which shall be headed "notice of bicycle/Pedestrian Path Easement vacation," and which notice shall be posted ~.n at least two conspicuous places in yr on the area proposed to be vacated.
