An ordinance initiating the vacation of the following described
alley, to-wit:
That portion of the North-~Sauth Alley abutting Lots
1, 2, 3, and 4, and that portion of the East-west
Alley abutting Lots 4 and 5, all in Block 1G, Eugene
Driginal Plat as platted and recorded in Book A,
Page 2 of Lane County 4regan Plat Records, Lane County,
oregon.
PRQVIDED, howe~rer, that the owners of the above des-
cribed property will pay the cost of relocating exist-
ing utilities therein and will provide the necessary
area for movement of vehicular traffic as required
by the City Public works Department. ~AV 79--2 Fifth St. ~
THE CITY of EUGENE DOES ORDAIN AS FoLL4WS:
Section 1. The City Council of the City of Eugene herein.ini-~
tiates the vacation proceedings vn its own authority without peti-
tion or consent of the property owners, except as provided by statute,
of the above described alley.
Section 2. A hearing sha~.l be held upon the proposal. to vacate
the alley as herein provided, and the hearing shall be held on the
20th day of February, 19$4, at noQnPacific Standard Time of said date,
at the Council, Chambers at City Hill, Eugene, Oregon, at which time
all persons will be heard upon objections or suggestions with regard
to the vacation, and at said time the Cauncil will provide for the
vacation of the alley or deny such vacation, and in case the vacation
is made, will provide and make provision for any damages sustained
by local assessment.
Section 3. The City Retarder is hereby directed to immediately
publish once each week for four consecutive weeks in a newspaper pub-
lished in Eugene, Lane County, Oregon, notice of the proposed vaca-

tion. The notice shall give a description of the area to be vacated
as herein set out; state the date when this ordinance was passedr the
name of any petitioners petitioning far the vacation, and the date
when the petition, together with any objections or remonstrances which
may be made in writing and filed with the Recorder of the City of
Eugene prior to the date of the hearing, will be heard and considered.
Section 4. The City Recorder shall forthwith and within five
days after the first publication of the notice post, or cause to be
posted, at or near each end. of the proposed vacation a copy of the
foregoing, which shall be headed "Notice of ~l~.ey vacation" and
which notice shall be pasted in at least two conspicuous places in or
on the area proposed to be ~racated.
The posting and the fist day of publication of the notice shall
be not less than twenty-eight X28 ~ da~rs before the time set for hear-
ing.

NOTICE IS HEREBY CIVEN~that at a meeting of the City Council
of the City of Eugene, held at the Council Chambers at City Hall,
Eugene, Dregon, on the lath day of January, 1984, there were passed
by the City Council and approved by the Mayor of the City of Eugene,
Lane County, Oregon, ordinances setting hearings to be held on the
20th day of February, 19$0, at 12:00 noon, Pacific Standard Time,
at the Council Chambers at City Hall, Eugene, Oregon, for the pur-
pose of hearing remonstrances and protests against the vacations by
ordinance of the City Council of the following:_
BICYCLE/PEDESTRIAN PATH EASEMENT VACATION
The southerly ten X10} feet of Lot 105, Dakway First Addi-
tion as platted and recorded in ~oqk 69, Page 31, Lane
County Plat Reoords, in Section 2d, Township l7 South,.
Range 3 West, ~Tillamette Meridian, Eugene, Lane County,
Qregon.
RESERVING herein an easement an the ground, above the
ground and beneath the ground for purposes of a public
utility easement as es ~ablished as a part of the plat of
Fairway View PUD, and the right to enter thereon for pur-
poses of construction, reconstruction and maintenance.

The City Council will consider and act upon the proposed vaca-
tions on the 20th day of February, 1980, at 12:00 o'clock noon,
Pacific Standard Time, at the Council Chambers at City Hall, Eugene,
Oregon, and will consider Ordinances vacating the above. All per
sons having objections thereto or remonstrances or protests are here-
by notified to present the same to the City Council in writing prior
to said hearing or at said time and place.
