HomeMy WebLinkAboutOrdinance No. 18559ORDII~IANCE NO. ~~q AN ORDINANCE CONCERNING DUPLEX, TRIPLEX, AND FOURPLEX REGULATIONS; AMENDING SECTIONS 9.310, 9.322, 9.324, 9.534, 9.550, 9.586, AND 9.592, OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Section 9.310 of the Eugene Code, 1971, is hereby amended by designating the present provisions thereof as subsection ~1}, and adding a new subsection ~2~ thereto, to read and provide: 9.310 Permitted Buildings and Uses. ~2~ In the RA district, duplexes, triplexes, and fourplexes shall be permitted as hereinafter specifically provided, subject to the general provisions and exceptions set forth beginning with(and following section 9.532, on lots in subdivisions containing ten or more lots which have received tentative appro~ral after the effective date of this subsection, if the following criteria are met: ~.a} That the lot contains a minimum area of 1. 10,000 square feet for duplexes; 2. 15,000 square feet for triplexes; and 3. 20,000 square feet for fourplexes. fib} Any duple, triplex or fourplex developed under this provision is limited to one and one-half stories in height within 2Q feet of any interior lot ,lines. ~:c7 A minimum of two parking spaces per unit is provided. No parking area shall accomodate more than four spaces, and parking areas must be separated by at least ten feet of landscaped area. All parking areas shall be landscaped in accordance with section 9.592 (c~ . ~~d} In any one subdivision, not more than 25 percent of the lots may be designed for duplexes, l5 percent for trip luxes , and 10 percent for four-~ plexes. At least 50 percent of the lots resulting from any one subd%vision must be designed for single- fan~ily development. l~hen applying this requirement, fractions shall be reduced to the next-lowest full number. Section 2. The caption immediately preceding Section 9.322, and Section 9.322 of the Eugene Code, 19?1, are hereby amended to Ordinance ~- 1 18559 read and provide: R--1 Law Densit Residential District 9.322 Description and_purpose.~ The R-1 Low-Density Resi-- dent~ial District ~s intended for low density, urban single family residential, and planned unit development uses. A stable and healthful environment, together with the full range of urban services, makes this the most important land use of the community. Section 3. Section 9..324 of the Eugene Code, 1971 is hereby amended by designating the existing provisions thereof as subsec- tion tl~ and amending the first paragraph thereof, and by adding a new subsection t27 thereto, to read and provide: 9.324 permitted Rui.l~di.n~s and Uses. ~1~. Section 5. Subsection ~c}. of Section 9.550 of the Eugene Code, 1971, is hereby amended to read and pa~ovide: 9.558 Cluster Subdivisions ~in RA and R~l Districts. _~c~ Maximum density, defined for this section as total dwelling units divided into the total area included in the application, does not exceed four dwelling units per acre and does not exceed that per- mitted~by the district or sub-district in which the subdw%sion is to be located, taking into account the provisions of sections 9.348 to 9.310 and 9,322 to 9.324 for duple, triplex, .and fourplex development. Section 6. Subsection ~a}2, of Section 9.586 of the Eugene Code, 1971, is hereby amended to read and provide: 9.5 8 6 Parkin,g_ Spaces ,,,, Req~i,red . 2. Dwelling, two-~~amily or ~nultip~.e 1-l/2 for each dwelling unit; where fractioned, next highest full unit, except development in RA and R-1 Districts pursuant to subsections ~ 2 ~ of sec- tion 9,314 or 9.324 shall provide a minimum of two parking spaces per unit. Section 6. Section 7. That the provisions contained herein concern the public welfare and safety and therefore, an emergency is hereby de-- clared to exist, and th~.s ardinar~ce shall become effective immedi~ ately upon its passage by the City Council and approval by the ~ayar.
