HomeMy WebLinkAboutOrdinance No. 18561ORDINANCE NO. ~~ AN ORDINANCE DESYGNATrNG THE N~AS4NIC CEN~ETER~' AND HOPE ABBEY MAUSOLEUN~ AS HISTORIC LANDMAR~i5 WITHIN THE CITY DF EUGENE, OREGON. The City Council of the City of Eugene finds that: Pursuant to Sections 2.442, 2.407 and 2.408 of the Eugene Code, 1971, the City Council has the authority and responsibility, subject to the limitations contained therein, to designate certain buildings, structures, other physical objects, including their sites, and geographic areas witha.n the City as Historic Landmarks. The Eugene Masonic Lodge No, ll AF & AM, has applied for His- toric Landmark designation for the Masonic Cemetery and Hope Abbey Mausoleum. Based upon the reports received from the Historic Re- view Board, the materials that have been transmitted therewith and the evidence presented, the application for designation as Historic Landmarks is consistent with applicable statewide and locally- adopted plans, and the improvements for which Historic Landmark designation has been requested meets one or mare of the criteria required for Historic Landmark designation, Now, therefore, based upon the above findings, and the pre- liminary staff notes and minutes of the Historic Review Board of November 15, 1979, the materials that have been transmitted there- with and the evidence presented, the City Council hereby adopts the specific affirmative findings contained therein, and THE C2TY 4F EUGENE ODES DRDATN AS FoLLQWS: Section 1. Under authority of Section 2.408 of the Eugene Code, 1971, the Masonic Cemetery and Hope Abbey Mausoleum, which are located on the following described real property: Tax Lot 4700 - Assessor's Map 18-03-05-42 The Amended Plat of Masonic Cemetery in Section 5, Township l8 South, Range 3 'hest of the Willa- mette Meridian as platted and recorded in Book 2 of plats, Page 75, records of Lane County, Oregon; excluding the following described property: Beginning at the iron rod marking the northeast corner of the Amended Plat; thence, west l18.10 feet along the north line of said cemetery to a point marked by an iron rod; thence, South 41°OS' East 179.54 feet to an iron rod set on the east line of said cemetery; thence North. 135.22 feet to the point of beginning in Lane County, Oregon. are hereby designated as Historic Landmarks. Ordinance - l 1856/ Section 2, The Masonic Cemetery and Hope Abbey Mausoleum shall be controlled by the restrictions set forth in Exhibit "A" and by Sections 2.409 through 2,411 of the Eugene Code, 1971. Section 3. The Eugene Masonic Lodge No. 11 AF & AM, owner of the Masonic Cemetery and Hope Abbey Mausoleum referred to herein may apply to the City for financial assistance as provided in Section 2.412 of the Eugene Code, 1971. Section 4. The Finance Direct®r is hereby directed to record a copy of this Ordinance, including the Exhibit hereto, in the Lane County official Deed Records. Alterations which are necessary to repair vandalism, such as repair of head- stones, will be reviewed by the Historic Review Board staff and will be referred to the I~istoric Review Board only on appeal, Hape Abbey Mausoleum ~- Alteration of the exterior of the Hope A~b~Y ~~usole~--m~ha-l-l--bes-~bj-pct---to- review- _by the --H%s-~o-~ic __ ---- - Review Board as set forth in Section 2.4D9 of the Eugene Code, 1971. Proposed alterations to the Mausoleum shall be in charac- ter with the structure's original exterior or the Egyptian Revival style of architecture. Repairs and Maintenance Section: The repair and maintenance of the exterior detailing of the Mausoleum and of the Cemetery headstones and other Cemetery accout- erments with materials and craftsmanship that duplicate the origi- nal or replace existing in composition, design, color, and other visual qualities, shall be permitted without an alteration permit. For all other changes, an alteration permit shall be required as specified in Section 2.49 of the Eugene Code, 1971. Use Section: Designation of the N~asonic Cemetery and Hope Abbey Mausoleum as an Historic Landmark will not affect uses permitted under their PL Public Land Zoning. Modifications Section: Zoning and sign regulations will not be affected by the His- toric Landmark designation of the Cemetery and Mausoleum. Exhibit ~' A" .
