HomeMy WebLinkAboutOrdinance No. 18580ORDTN.ANCE NO . ~~o ~ o D An Ordinance uacating the following described sanitary sewer easement, to-wit: A 34 foot wide sanitary sewer easement located on Lots 18 and 19 of Treehouse P.U.D. as platted and recorded on slide 73, file 199 in Lane County Oregon Plat Records. RESER'U'I.NG herein a 7 foot easement on the ground, above the ground, and beneath the ground for pur- poses of a public utility easement on and along the north and east boundaries of Lot l8 of the above described plat, and the right to enter there- on for purposes of construction and maintenance. Land Dynamics - E~' 79-13~ On the 9th day of January ~ 1980, the City Council of the City of Eugene passed Ordinance No. 15553 setting a hearing to be held on the 13th day of Februarys 1980, at the Council. Chambers at City Hall, Eugene, oxegon, at which time and place protests and remon- strances could be heard as to the proposed vacation of the above described sanitary sewer easement. Notice was du~,y and regularly gi~ren of the hearing and a hear- ing was held pursuant to the Ordinance a,t the Council Chambers, at City Hall, Eugene, Oregon, on the lath. day of February, 1980, at Noon, Pacific StandardTime, and at said time and place the Council heard all objections. All persons owning pxoperty abutting upon the sanitary sewer easement to be vacated ha~re consented to the vacation and agplied for the same.. THE CITY OF EUGENE DOES ORDAIN ~:S FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regulsr notice of the hearing was published and posted as ordinance - l 18580 by law required and no valid objections have been made at the hear- ing or filed. The consent. of the owners. of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the sanitary sewer easement. Section 2. The hearing was held on the lath day of February, 198D, at noon, Pacific Standard Tune, at the Council Chambers, City Hall, Eugene, Lane County, Oregon, and all matters necessary to be done in the premises have been duly and regularly completed. Section 3. The hereinabave described sanitary sewer easement is hereby ~racated, and the san,itaxy sewer easement sa vacated shall revert pursuant to the statutes o~ the State of oregon. Section 4.
