'' An Ordinancevacating the following described bicycle/pedes-- trian path easement, to-wit: The souther~.y ten ~~10 ~ feet of Lot 10 5 , Oakway First Addition ~s'~platted and recorded in Book 69, Page 31, Lane County Plat Records, in Section 20, Township 17 South, Range 3 West, V~illamette Meridian, Eugene, Lane County, oregon. RESERVTNG herein as easement on the ground, above the ground and beneath the ground for purposes of a public utility easement as established as a part of the plat of Fairway View PUD, and the right to enter thereon for purposes of construction, recon- struction and maintenance. ~.EV 79-12 L.J. Campbell} On the 16th day of January, 1950, the City Council of the City of Eugene passed Ordinance No. 1$555 setting a hearing to be held on the 20th day of February, 19$4, at the Council Chambers at City Hall, Eugene, Oregon, at which. time and place protests and remon- strances could be heard as to the proposed vacation of the above described bicycle/pedestrian path easement. Notice was duly and regularly given of the hearing and a hear- ing was held pursuant to th.e ordinance at the Council Chambers, at City Hall, Eugene, Oregon, on the 20th day of February, 19$4, at Noon, Pacific Standard Time, and at said time and place the Council heard all objections. All persons owning property abutting upon the bicycle/pedes- Irian path easement to be vacated h.~Ye consented to the vacation and applied fox th.e same. THE CITY OF EUGENE DUES ORDATN AS ~'ULLQWS: Section 1. The City Council ~f the C~.~ty of EL~.gene finds that due and regular notice of the hearing was published and pasted as Ordinance - 1 ISSSz by law required and no valid objections have been made at the hear- ing or filed. The consent of the owners of the abutting property has been du?.y and r-egularly filed in the proceedings and the public interest will not be prejudiced by the vacation of~ the bicycle/ pedestrian path easement. Section 2. The hearing was held on the 24th day of February, 198Q, at noon, Pacific Standard Time, at the Council Chambers, City Hall, Eugene, Lane County, oregon, and all matters necessary to be done in the premises have been duly and regularly completed. ,. Section 3. The hereinabo~re described bicycle/pedestrian path easement is Izereby vacated, and the bicycle/pedestrian path easement so vacated shall revert pursuant to the statutes of the State of Oregon. Section 4. the City Recorder i~s hereby directed to file a cer- tified copy of this ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certi- fied copy of this ordinance shall be filed with the Lane County Assessor and another cert~:f,ied copy shall be filed with the Lane County Surveyor.
