' y g ~ 'Iax Lot A portion of 700 -- Assessor'~s Map 17~-03~31~127. Lane County ~ Sv 79-7} THE CITY of EUGENE DOES ORDA2N AS FOLLQWS: Section 1. The City Council of the City of Eugene herein ini~ bates the vacation proceedings ~n its own authority without peti- tion or consent of the property owners, except as provided by statute, of the above described street. Section 2_. A hearing shall be held upon th.e proposal to vacate the street as herein provided, and th.e hearing shall be held on the 23rd day of April, 1980, at noon, Pacific Standard Time of said date, at the Council Chambers at City Hall, Eugene, oregon, at whici~ time all persons will be heard upon objections or suggestions with regard to the vacation, and at said time the Council will provide for the vacation of the street or deny such vacation, and in case the vaca- tion is made, will provide and sake provision for any damages sus- tained by local assessment. Section 3. Th.e City recorder is hereby directed to immediately publish once each week for four consecutive weeks in a newspaper pub- fished in Eugene, Lane County, Oregon, notice of the proposed vaca- tion. The notice shall give a description of the area to be vacated as herein set out; state the date when this ordinance was passed, the name of any petitioners peti,t.oni.ng for th.e vacation, and the date when the petition, together with any objections or remonstrances which Ordinance - l / 8597 may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after the first p~blicativn of the notice post, or cause to be posted, at or near each end of the proposed vacation a copy of the foregoing, which sha11 be headed ~~Notice of Street ~acation,'~ and which native shall be posted in at least two conspicuous places in or on the area proposed to be vacated. The posting and the first day of p~bl,icata~on of the notice shall ,, be not less than twenty-eight C28~. days before the time set for hear- ing.
