THE CITY OF EUGENE DOES O~DAIN AS FOLLOWS: Section 1. The City Council does hereby order a special elec- tion to be held in the City of E~gene, Or~90n, concurrently with the Lane County special election on Tuesday, May 20, 1980, at which election there shall be submitted to the electors of the City for their approval or rejection, the fQllowi~g Measures, to-wit: MEASURE. If ballot mea.su;J;e number 52 estab1ishi~g a new tax base for the City of EUgene of $21,250,000 is Ordinance - 1 185CfCj passed, the following Amendment is hereby added to the Eugene Charter of 1976: AMENDMENT X. (11 The city council may not levy a property tax for general city operations for a tiscal yeG~ unless the voters of the city approve the tax specifically for' that year, ex- cept that, to the' extent the tax is levied to finance an appropriation for that year recommended in the city budget by two-thirds of the budget committee, the council may levy the tax without that voter approval~ (2) The city council may not levy a property tax for general city operations of more than (9.1 $14,000,000 for fiscal y"ear. 1980-81, (J:> 1 $16,500,000 for fiscal year 1981-82, Cc '-- $19,000,000 for fiscal year 1982~83, nor (tll_ the city's tax base under Article XI, Sec- tion 11, of th,e Or~,gon Consti.tution fo:r a fiscal year after June 30, 1983. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: BE IT ENACTED BY THE ELECTORS O~ THE CITY OF EUGENE, OREGON: Sect'ion It! A new. tax bas:e of $'21,250,000 ,i.s hereby established for th,e City of E~gene" b~9inni~g July 1, 1980. Section 2.. The p'urpose of this. measure is to comply with the mandate of the Or~gon L~gislative Assembly, ex- pressed in Sections' 53 and. 54 of Ch.apter 241 of Or~gon Laws 1979, that the City submit to tts 'voters du.ri~g 1980 Uthe question of establish,i~g ~ new' ta4 basel.' for the City in lieu of the City's present tax ba~e under Article XI, Sec- tion 11, of th.e OI;~gon Consti.t-ution~ Secti.on 3. The Ci.,ty' is re.qui,red by th.e State 1979 Property Tax Relief Act to submit to its voters a proposed new tax base. Thi's proposed new base would be $21,250,000, would help finance 'needed municipal services b~ginning July 1, 1980, and would allow lo~g ra~ge financial planning for subsequent years. The 'new base would update the City's pre- Ordinance - 3 I ~5'1t:t sent tax base of $5,156,949, which was derived from a tax base approved by the voters in 1962, and which has since proved inadequate year after year because of the growth of the City, inflation, and increasi~g needs for municipal ser- vices. In proposi~g the new base, the Council does not in- tend to immediately levy taxes to the full amount possible under the new base, but instead intends to be limited by the Charter Amendment submitted as a companion measure (Measure No. 511... Section' 4 ~ Thi,s .measure sh~ll become effective July 1, 1980. Section 2. The proposed measures shall be placed upon the official ballot by the City Recorder.. There shall be furnished to the County Clerk for Lane County a certified copy of the ballot titles for the measures and nmooers of the measures to be voted upon. The City Attorney shall prepare and the City Recorder shall furnish the ballot titles for the measures and direct that the County Clerk for Lane County place the measures upon the r~gular ballot to be used at the Lane County special election to be held on May 20, 1980, to be voted upon by the electors of the City at the special City election. Section 3. The necessary poll books, ballot boxes, tally sheets and such othe'r s.upplies for each. p.recinct as are necessary for the carryi~g on of the election shall be furnished by the County Clerk for Lane County, and the supplie~ shall, be delivered to the Election Board. The City Council hereby orders that the election shalT be held as a special election for the City of Eugene concur- rently with the Lane County special election on Tuesday, May 20, 1980 and hereby des~9nates as the PQl1i~9 places for the election in the Ci ty of E~gene th.e polli~9' places established and designated for the Lane County special election, and the City Council does hereby appoint the Clerks appointed to serve at the Lane County special election to serve in each of the polli~g places for the City election. Section 5. The polls shall be open in each of the voti~g pre- cincts at 8:00 o'clock a.m., Pacific Dayl~ght Time, and shall be kept open until 8:00 o'clock p.m., Pacific Daylight Time, on elec- , . tion day. Section 6. The Clerk '~cti~g ~s chairman of the Election Board in the Lane County special election shall be chairman of the same Board of which he or sh.e is 'a member in the Ci ty election, and the ballots shall be counted and tabulated ~nd the results certified as provided by law'. Section 7~ The City Recorde~- is hereby directed to. give not less than ten days notice of the special election by publication of one notice thereof in the E~gene ~~9ister-Guard, a newspaper pub- lished in the City and of gene~al circulation therein. Section 8. The matters contained herein af~ect the peace, health, and safety of the citizens of the City of E~gene, and, therefore, an eme~gency is hereby declared to exist, and this Ordi- Ordinance - 5 J BSCf'l nance shall become effective immediately upon its pass~ge by the City Council and approval by the Mayor.
