TIlE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Subsection ell lal"l ~ of Section 9. 0. 6 O. of the E~gene Code, 1971" .is hereby amended to read and provi,de: 9.060 Platting and Mapping Standards - Lots and Parcels. 1. Width~ Each lot and. parcel shall have an average width between the side lines of not less than 60 feet~ Each corner lot and parcel and each authorized key and butt lot and parcel shall have an average width between the lot and parcel side lines of not less than 65 feet. Each duplex divi- sion lot shall have an average width between the side lines of not less than' 45 feet. Section 2. Subsection ell {al,3. of Section 9. 060 of the E~gene Code, 1971, is hereby amended to read and provide: 9.060 Platting and Mapping Standards - Lots and Parcels. 3. Area. Each lot shall comprise a minimum of 6,000 square feet or as otherwise stipulated in the zoning district where located, except a duplex division lot created in accordance with section 9. 060 Cll..Cb14. Section 3. Subsection U1Ca14. of Section 9.060 of the Eugene Code, 1971, is hereby amended to read and provide: 9.060 Platting and Mapping Standards - Lots and Parcels. 4. Frontage. Each lot and parcel other than a duplex division lot shall have frontage of not less than 60 feet upon a street having a proposed right-of~way width of at least 50 feet and not less than such width as called for in the Master Road Plan, except that a lot or parcel on the outer radius of a curved street or facing a circular end of a cul-de-sac shall have frontage of not less than 35 feet upon a street, measured on the arc. Subsection (l},(bl of Section 9.060 of the E~gene Code, 1971, is hereby amended by addi~g'new ~ubsections 4. and 5. thereto, to read and provide: 9.060 Platting and Mapping Stand:ards ~ Lots an'd .p'arcels. Cb) Excep.tions : 4. Duplex division lot. The planning direc- tor may in his discretion authorize width~ area, and frontage exceptions for duplex division lots in accordance with sections 9.060CllCa}1., 9.060 (1) (a)3., and 9.060Cll.Ca}"4. where there appears to be no reason not to allow the division of an exist- ing conforming duplex lot containing one two-family dwelling (duplex) provided the original 'lot con- tains at least 10,000 square feet of area and the resulting duplex division lots are relatively equal in size - a ten percent deviation or less and a minimum area of 4,500 square feet, reasonable amount of frontage, and a minimum average width of not less than 45 'feet. Assurance must be provided that each unit establish independent utility ser- vice, including but not limited to water, electric, and natural gas, unless common utilities are approved by the affected utility agency and are adequately covered by easements. A single-family structure. could be created only if each lot resuit- ing from a duplex division satisfies the general requirements of width, depth, a~d frontage other than duplex division lot exceptions specified in section 9. 060 Clt Cat. 5. Dupl'ex divis.ion lot - agreement. Prior to. granti~~ fin~l ~pproval fo~ cxe~tion of a.duplex di visi_on lot the J?lanni~g di.rector may 'require. the applicant~l. to enter into a written agreement, in a form approved by the city attorney, that estab- lishes the rights, responsibilities and liabilities of the parti~s with respect to maintenance and use of any common qreas of the duplex such as, but not limited to common walls, roofi~g, water pipes and electric~l wiring~ Such agreement shall be in a form suitable for recording, and shall be bindtng upon the heirs, executors', administrators and assigns of the parties~ Section 5. Section 9 a 254 of th,e E~gene Code, 1971, is. hereby amended by addi~g a new de,fini tion to be inserted in alph.abetical order therein, to read and provide: Ordinance - 2 l'il,oo 9.254 Definitions. Duplex division lot. A parcel of land with an area of at least 4,500 square'" feet containing one unit of an existi~g duplex structure resulting from the division of a confo'rming duplex lot at least 10,000 square feet in area~' ". Section 6. Subsection ell- (~l- of Section 9. 542 of the Eugene Code, 1971, is hereby amended to read and provide: 9.542 Int'erior Yards. Cal All lots OJ; development sites in the AG, RA, R-l, R-2, R-3, and R-4 districts shall have interior yards of. not less than five feet except for a duplex division lot or where a utility easement is recorded adjacent to a side lot line, there shall be a side yard no less than the width of the easement. Section 7. Subsection (lICb} of Section 9.546 of the E~gene Code, 1971, is hereby.amended to read and provide: 9.546 Lot Area; Lot Area Per Dwelling Unit. tb) In the RA, R-l, R-2, R'I:"'3, R-4,. RP, C-l, and C-2 districts, each lot or development site shall have a minimum area of 6,000 square feet unless a duplex division lot or as may be established by a subdistrict. Section 8. Section 9.548 of the Eugene Code, 1971, is hereby amended by addi~g a new subsection Cd 1. thereto, to read and provide: 9.548 Lot Area Exceptions. That the provisions contained herein concern the public welfare and therefore, an eme~gency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the M~yo~.
