IS6v~ An Ordinance vacating the following described Pedestrian Right of way, to-wit: A 10-foot wide pedestrian right of way contiguous to Lots 12, 13, 21, and 22, Block 8 as platted and recorded in Second Addition to Cambridge Park, in book 53, page 9, Lane County Oregon Deed Records. Reserving herein an easement for public utilities above ground, on ground level, and underneath the ground, and the right of access to construct, re- construct, and maintain the same over the above de- scribed property. ~Abarr, Hanamura, Spear, Stredde EV 79-1~ On the 2nd day of May, 1979, the City Council of the City of Eugene passed Ordinance No. 18390 setting a hearing to be held on the 13th day of June, 1979, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of the above described Pedestrian Right of way. Notice was duly and regularly given of said hearing and a hearing was held pursuant to said Ordinance at the Council Chambers at City Hall, Eugene, Oregon, on the 13th day of June, 1979, at noon Pacific Daylight Savings Time, and at said time and place the Council heard all objections. All persons owning property abutting upon the Pedestrian Right of way to be vacated have consented to the vacation and applied for the same. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1, The City Council of the City of Eugene finds that due and regular notice of the hearing was published and 18609 posted as by law required and no valid objections have been made at the hearing or filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the Pedestrian Right of Way. Section ~. The hearing was held on the 13th day of June, 1979, at noon, Pacific Daylight Savings Time, at the Council Chambers at City Hall, Eugene, Lane County, Oregon, and all matters necessary to be done in the premises have been duly and regularly completed. Section 3. The hereinabove described Pedestrian Right of Way is hereby vacated, and the Pedestrian Right of Way so vacated shall revert pursuant to the statutes of the State of Oregon. Section 4. The City Recorder is hereby directed to file a certified copy of this Ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with the Lane County Assessor, and another certified copy shall be filed with the Lane County Surveyor.
