AN ORDINANCE CONCERNING LAND USE AND SIGN DISTRICT
CLASSIFICATION AND AMENDING THE zONING MAP AND SIGN
DISTRICT MAP OF THE CITY DF EUGENE, OREGON
THE CITY COUNCIL CF THE CITY OF EUGENE FINDS THAT:
Pursuant to the provisions of ORS 227.215 and Sections 8.813, 9.275, and
9.665 through 9.684 of the Eugene Cade, 1971, the City Council has the authority
and responsibi~ ity, subject to the ~ imitations contained therein, to change the.
zoning and sign district classification of property within the City of Eugene;
Based upon the report of the Planning Commission, the materials trans-
mi tted therewith, and the evidence presented before the Planning Cammi ssi on and
this City Caunci ~ , the request far zone change and sign district change o~f -
classification i s i n conformance with the General Pi an; there i s a pubs i s need
far the change i n zone; .and the ~ publ i c need can. best be served by changing the
classification of the property;
NOW, THEREFORE,
- Based upon the foregoing, the City Counci 1 hereby adopts as its own the'
. ~ specific affirmative findings contained i n the Pl anni ng~ Depart~ent staff notes
`~ of March 4, 195D, and the Planning Commission minutes of March 4, 198x, for the
. reasons set forth therein, and

THE CITY OF EUGENE ODES ORDAIN AS FOLLOWS:
.Section 1. As provided by Sections 9.275 and 8.625 of the Eugene Code,
1971, the zoning map, the sign district map, and the zoning ardi Hance schedul e
of district changes and the sign code schedule of district changes are hereby
amended to reflect the fol 1 owl ng change of zone and sign di stri c~:

described on the attached Exhibit "A", located on the south side
of 5th Avenue between Pearl and Oak streets:
Change of zone from M-~2 Light Industrial District to SD Special
. Development District, subject to the development standards as set
. forth in Exhibit."B", and Change of Sign District from Industrial

Section 2. The Planning Director be and is hereby authorized and directed
to cause the zoning map, the sign district map, the schedule of sign district

~~ of district changes attached to Chapter 9 of the Eugene Code, 1971, to show the
faregai ng change of c1 assi fi cati on of area and to note thereon the rub e with

Special District Development Standards
The area described ~ n the attached Exhibit "A" i s hereby made a part of
the Fifth Avenue Development District, which has been c1 assi fi ed as
an SD Special Devel apment District. As a part of that district, the
property described i n Exhibit "A" i s subject to the special district
development standards of the Fifth Avenue Devel apment District. Those
standards are as fol ~ ows
~ ..Description ,and Purpose Section
The area generally known as the Fifth Avenue Development
District has been classified as an SD Special Development
District i n order to achieve the fol 1 awi ng purposes
a. Ta allow preservation of the existing substantial bui ~ di ngs;
b. To al ~ ow redevelopment of the area wi th a vari ety of commercial
'and industrial uses;

c, To encourage redevelopment which i s pri marl ly pedestri an-
oriented with only limited provision ,for autamobi l~e use; and
d. To insure that new level apment conforms with the character of the
existing development.
In order to achieve the purpose of this particular special district,
i t i s necessary that an association of all property owners involved
be formed.. ~ Thi s association shat 1 assume, at a mi ni mum, those
responsi bi 1 i ti es herei Wafter detailed.
2. Use Section
The purpose of this district i s to encourage a vari ety of uses, ~n
1 i ne with that purpose, only these uses which are vehicle-~ori ented
shat 1 be expressly excluded as new developments or redevel opments~
fie. g., .service stations, warehouses, repair garages, drive-in
foci 1 i ti es, etc. ~ . Within this broad framework, i ndi v1 dual
proposals shall be evaluated vn the basis of consistency with the
expressed purpose of this district,
A conditional use permit shall be required for all new develop
ment ar redevelopment i n the area. When making findings concerning
a proposed development, the Hearings offi ci al~ shall take into

3. Development Standards
In this special development district the general standards set forth ~ n

Qne memeber of the Fugene Planning Department Staff shall serve

i n accordance with the procedures set forth i n Secti an 9.696 et. sea,
of the City Code. The Hearings Official shat ~ , i n his review, evaluate
. new development or redevelopr~ent proposals .for compati bi 1 i ty with
the Civic Center Design Plan. The Planning Commission shat 1 review
this special district two years after its creation to .evaluate the
results of the standards set forth and the success of the special
district i n meeting the purposes for its creation. ,
