An Ordinance initiating the vacation. of the following described
public utility easement, to~-wit:
The nor~theastexly 3 feet of an existing ~,4 foot wide
public utility easement of the alley running through
Block 3, Plat of Blair Street Addition as recorded in
Book 3, of Platsr Page 9~ Records of Lane County

THE CITY OF EUGENE DoE5 O~RDAI~N AS FOLLOWS:
Section 1. The City Council of the City o,f Eugene herein ini-
tiates the vacation proceedings on its own authority without peti-~
tion or consent of the property owners, except as provided by sta-
tute, of the above described public utility easement.
Section 2. A hearing shall be held upon the proposal to vacate
the public utility easement as herein provided, and the hearing
shall be held on the 11th day of June, 19$0, at noon, Pacific Day-
light Time of said date, at the Council Chambers at City Hall,
Eugene, Oregon, at which time al,l persons wild be heard upon objec-
tions or suggestions with regard to the vacation, and at said time
the Council will pr.avide for the vacation o~ the public utility
easement or deny such.~racaton, and in case the vacation is made,
will provide and make provision for any damages sustained by local
assessment,
Section 3. The City Recorder is hereby dirQcted to immediately
publish once each week for four consecutive weeks in a newspaper pub--
lisped in Eugene, Lane County, Oregon, notice of the proposed vaca-
tion.. The notice shall give a description of the area to be vacated
as herein set out; state the. date when this ordinance was passed, the
ordinance ~- 1

name of any petitioners petitioning for the vacation, and the date
when the petition, together with any objections or remonstrances which
may be made in writing and filed with the Recorder of the City of
Eugene prior to the date of the hearing, will be heard and considered.
Section 4. The City Recorder shall forthwith and within five
days after the first publication of the notice post, ar.cause to be
posted, at or near each end of the proposed vacation a copy of the
foregoing, which shall be headed ~~Notice of Public Utility Easement
vacation," and which notice shall be posted in at least two canspi~
cuaus places in or on the area proposed to be vacated.
The posting and the first day of pub~.ication o~ the notice shall
be not less than twenty-eight ~, ? 8 ~ days be dare th.e time set for hear
ing.

To ALL PERSONS WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that at a meeting of the City Council
of the City of Eugene, held at the Council .Chambers at City Hall,
Eugene, Oregon, on the 7th day of May, 1980, there was passed by
the City Council and approved by the Mayor of the City of Eugene,
Lane County, Oregon, an Ordinance setting a hearing to be held on
the 11th day of June, 1980, at 12:00 o'clock noon, Pacif is Daylight
Time, at the Council Chambers, City Hall, Eugene, Oregon, for the
purpose of hearing remonstrances and protests against the vacations

Plat Records, reserving all public utility, sidewalk,
and slope easements established as part of the plat
of Second Addition to Sweetbriar Subdivision as platted
and recorded on File 73, Slide~308, of the Lane County,
Oregon plat records, and the right to enter in and upon
for purposes of maintenance, repairs and replacements.
