HomeMy WebLinkAboutItem 2D - Kaufman House ZoneEUGENE CITY COUNCIL AGENDA ITEM SUMMARY Initiation of Land Use Code Amendment: To Create a Special Area Zone for the Kaufman House (Kaufman Senior Center) Meeting Date: May 24, 2004 Agenda Item Number: 2D Department: Central Services Staff Contact: Glen Svendsen www. ci. eugene, or. us Contact Telephone Number: 682-5008 AGENDA ITEM SUMMARY The City of Eugene Facility Management Division requests City Council initiation of an amendment to Chapter 9 (Land Use) of the Eugene Code to facilitate the review process for the proposed Historic Special Area Zone (SAZ) to be applied to the Kaufman Center property at 996 Jefferson. If initiated by the City Council, the proposed amendment would be the subject of public hearings by the Planning Commission and City Council prior to action. City Council initiation of the code amendment process does not indicate support for the amendments. BACKGROUND Council Action History In April 2001, the council asked the City Manager to direct Facility Management staff to explore how to sell the Kaufman Annex separately from the Kaufman House (Kaufman Senior Center). The two properties are currently tied together under a Conditional Use Permit (CUP). Approval of the proposed zone change will eliminate the need for the existing CUP. The proposed zone change is for the Kaufman House only and will allow either continuation of the current use or a new use that falls within the allowable uses of the new zone. Upon dissolution of the CUP, the Kaufman Annex may be considered for disposal as surplus property. The council passed a motion at its August 13, 2003, work session to dedicate net proceeds from a sale of the annex to the Kaufman Trust Fund. Policy Issues There are no policy issues associated with this item. If the council initiates the amendment proceedings, policy issues will be determined and considered during public review and action on the proposed amendments. Those issues will be determined and considered during public review and action on the proposed amendments. Other Background Information A 'Land Use Alternatives Report' by Satre Associates, P.C. dated February 2003, explored possible options for action regarding the future of these properties. The council was briefed about the recommendations of this report in a March 5, 2003, memo from Facility Management Division Manager Glen Svendsen, and also in a June 18, 2003, memo from Jim Carlson and Angel Jones. The option which provided the best alternative to preserve the historic structures and gardens while allowing for a range of uses compatible with the surrounding neighborhood involved designating both properties as Historic City Landmarks (completed in December 2003) followed by the creation of a Historic Special Area Zone for the Kaufman House only. The re-zoning will allow the current use as a senior center (operated by Emerald Empire Council on Aging - known as EECA) to continue and would allow an expanded list of neighborhood-compatible uses for the future. The Kaufman Annex property will retain the R-2 zoning, allowing it to be used in the future as a residence. Satre Associates, on behalf of the City of Eugene Facility Management Division, has submitted an application to the City to amend Chapter 9 of the Eugene Code to create a Historic Special Area Zone classification and to change the zoning of the Kaufman House property to that new classification. City planning staff asked Facility Management to request that the City Council initiate the amendment proposed in the application. City staff has determined that the application will be processed through a Type V (legislative) application process. EC 9.7505 Type V Application Requirements and Criteria indicates that land use code amendments are to be reviewed under the Type V application review process. EC 9.7510 City-Initiation of Applications provides that the City Council may initiate a Type V application on its own behalf. Timing Staff requests that the council take action on the initiation request at the May 24, 2004 meeting. OPTIONS The council has the option to: 1. Initiate the code amendment proceedings; or 2. Decline to initiate the code amendment proceedings. STAFF RECOMMENDATION Staff recommends Option 1 - initiate the code amendment proceedings.
