HomeMy WebLinkAboutOrdinance No. 18657(H 80-3) ORDINANCE N0. ~ (per 57 AN ORDINANCE DESIGNATING THE ALPHA TAU OMEGA HOUSE AS A HISTORIC LANDMARK WITHIN THE CITY OF EUGENE, OREGON THE CITY COUNCIL OF THE CITY OF EUGENE FINDS THAT: Pursuant to Sections 2.402, 2.407, and 2.405 of the Eugene Code, 1971, the City Counci 1 has the authari ty and ressons i bi 1 ity, subject to the limitations cantai ned therein, to designate certain buildings, structures, other physical objects, including their sites, and geographic areas within the City as Historic Landmarks. Based upon the report received from the Historic Review Board, the materials that have been transmitted therewith, and the evidence presented before the Historic Review Board and this Council , the application for designation as an Historic Landmark i s cans i stent with applicable statewide and l acal ly-adopted plans, and the Alpha Tau Omega House, including its site, for which Historic Landmark designation has been requested meets one ar more of the criteria required for Historic Landmark designation. NOW, THEREFORE, Based upon the foregoing, the City Counci 1 hereby adopts as its own the specific affirmative findings contained in the Historic Review Board staff notes and minutes of May Z9, 1950, for the reasons set forth therein, and THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Under authority of Section Z.4oS of the Eugene Code, 1971, the Ai pha Tau Omega House and its site, which i s located on the fol 1 owi ng descrrtbed real property is hereby designated as a Historic Landmark. Commencing at the Northwest corner of Lot 3 i n B1 ock 2 of Christian' s Addition to Lane County, Oregon, Eugene City, as platted and recorded at Page 601, of volume P, Lane County Oregon Deed Retards, and running thence South 44 feet, and 4 i nches thence East 160 feet, thence North 44 feet and 4 inches, and thence West 164 feet to the place of beginning, i n Eugene, Lane County, Oregon. And beginning at a poi nt 75.5 feet South of the Northwest corner of Lot Two ~2} Block nineteen X19}, Mulligan's Donation to Lane County, Oregon as per p1 at recorded at Page ZZ6 of Volume A, Lane County Deed Records, running thence South 44.5 feet more ar less to the Southwest corner of Lot Three ~3} of said Block nineteen €19}, thence East 80 feet, thence North 44.5 feet, more or less, to a point 75.5 feet South of the North line of said Lot Two ~2} i n B1 ock nineteen X19} , thence West to the place of beginning, bei ng a part of Lots Two ~Z} and Three ~3} B1 ock nineteen ~ 19} of Mul 1 i gan' s Donation to Lane County, Oregon. The Alpha Tau Omega House, and its site shall be controlled by the restrictions set forth in Exhibit "A" and by Sections 2.409 through 2.411 of the Eugene Cade, 1971. Section 3. The owner of the Alpha Tau Omega House and its site may make proposals to the City for its repair, maintenance or restoration as provided in Section 2.412 of the Eugene Code 1971. Section 4. The Finance Director is hereby directed to record a copy of this Ordinance, including the Exhibit hereto, i n the Lane County Offici a1 Deed Records, Passed by the City Council this Reproved by the Mayor this ~~ day of !i~ a City Recorder, HC64b1 19 S~ o?~ aay of u.he 19 Sc~ ~~ Mayor ORDINANCE--Page 2 of 2 18657 EXHIBIT A RESTRICTIONS--HISTORIC LANDMARK ~H 80-3} Repair and Maintenance Section : Repair and maintenance of the exterior detai 1 i ng of the Alpha Tau Omega House that duplicates the original or replaces existing in campasition, design, color, and other visual qualities shall be permitted without an alteration permit. For al ~ other changes, an alteration permit shall be required as specified in Section 2.409 of the City Code. 5t and ands Section Alteration of the exterior of the R1 ph a Tau Omega House wi 11 be reviewed by the Historic Review Board as provided for in Section 2.409 of the City Code. However, alterations of a minor nature, where there is little or no impact on the landmark, where the alteration could 1 ater be removed without adverse effect, and which conform to the criteria outlined in Section 2.4093} may be reviewed by H i star i c Review Board staff and need not otherwise be con s i - dered by the Board. Proposed alterations to the House shall be in character with the structure's original exterior or the Craftsman style of architecture. LISP ~PC't ~fln' Uses allowed under the structure's C-3 Central Business District honing shall be allowed as long as they do not adversely affect the character of the exterior of the structure. Cade Modification Section: Zoning and sign regulations wi 11 not be affected by the historic 1 andmark designation of the Rlpha Tau Omega House. HC64b9
