AN ORDINANCE DESIGNATING THE EUGENE MILL AND ELEVATOR
AS A HISTORIC LANDMARK WITHIN THE CITY OF EUGENE, OREGON
THE CITY COUNCIL OF THE CITY OF EUGENE FINDS THAT:
Pursuant to Sections 2.402, 2.447, and 2.408 of the Eugene Code, 1971,
the City Council has the authority and responsibility, subject to the limitations
contained therein, to designate certain buildings, structures, other physical
objects, including their sites, and gevgraphi c areas wi thi n the City as Hi stori c
Landmarks.
Based upon the report received from the Historic Review Board, the
materials that have been transmitted therewith, and the evidence presented before
the Historic Review Board and this Council, the application for designation as
an Historic Landmark i s consistent with applicable statewide and 1 acal ly-adopted
plans, and the Eugene Mi 11 and E1 evator, for which Hi stori c Landmark desi gna-
tion has been requested meets one or more of the criteria required for Historic
Landmark desi gnat i an.
NOW, THEREFORE,
Based upon the foregoing, the City Council hereby adopts as its own the
specific affirmative findings contained in the Historic Review Board staff notes
and minutes of May 29, 1950, for the reasons set forth therein, and
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Under authority of Section 2.405 of the Eugene Code, 1971,
the Eugene Mill and El evator which is located on the following described real
property i s hereby designated as an Historic Landmark.
Beginning at the Northerly right-of-way line of the Southern Pacific
Company within the City of Eugene at a poi nt 400 feet South and 139 feet
Sast of the Northwest corner of the Hi lyard Shaw Donation Land C3 aim No,
56, Township l7 South, Range 3 West of the Willamette Meridian; said point
being 40 feet distant Westerly when measured at right angles toy the
relocated center 1 i ne of the Ferry Street Bridge 6th and 7th Street
Connection at Engineer's 5tati on 13+72.45; thence North 54° 43' West along
the Northerly right-of-way line of the Southern Pacific Railroad 342.49
feet to the South right-of-way line of 5th Avenue; thence East 127 feet to
the East end of said 5th Avenue; thence along said East end North 66 feet;
thence West 51.4 feet to the Southwest corner of fractional Lot S, Block
10, EUGENE CITY, as platted and recorded in Book "A", Page 2, Lane County
Oregon Judgment Docket; thence North 160 feet to the Northwest corner of
fractional Lot 5 of said B1 ock 15; thence East to the intersection of the
North 1 i ne of Lot 6, Block 11, EUGENE CITY, with the West 1 i ne of that
tract conveyed to the State of Oregon, by Deed recorded March 16, 1949, in

Book 39~, Page 1Z4, Land County Oregon Deed Records; thence Southerly
along said wWst 1 i ne to the point of beginning, i n Lane. County, Oregon;
EXCEPT THEREFROM that portion lying within the alley i n Block l5, EUGENE
CITY, as platted and recorded in Book "A", Page 2, Lane County Oregon
Judgment Docket, in Lane County, Oregon.
Section 2. The Eugene Mill and Elevator shall be controlled by the
restrictions set forth in Exhibit "A" and by Sections 2.409 through x.411 of the
Eugene Code, 1971.
Section 3. The owner of the Eugene Mill and Elevatar may make proposals
to the City for its repair, maintenance, or restoration as provided i n Section
2.41 of the Eugene Code, 1971.
Section 4. The Finance Director is hereby directed to record a copy
of this Ordinance, including the Exhibit hereto, i n the Lane County Official
Deed Records.

RESTRICTIONS--HISTORIC LANDMARK ~H 80-2}
Repair and Maintenance Section:
Repair and maintenance of the exterior detai 1 ing of the Eugene Mill and
Elevator that duplicates the original or replaces existing in composition,
design, color, and other visual qualities shall be permitted without an
alteration permit. For all other changes, an alteration permit shall be
required as specified in Section x.409 of the City Code,
Standards Section
Alteration of the exter i ar of the Eugene Mil 1 and E1 ev ator wi 11 be reviewed
by the Historic Review Board as provided for in Section 2.409 of the City
Code. However, alterations of a minor nature, where there is little or no
impact on the 1 andmark, where the alteration could later be removed wi thaut
adverse effect, and which conform to the criteria outlined in Section 2.4093}
may be reviewed by Historic Review Board staff and need not otherwise be
considered by the board. Proposed alterations to the elevator shall be in
character with the structure's original exterior.

affect uses permitted under its M-2 Light Industrial zoning as long as they
do not adversely affect the exterior character of the structure.
Code Modification Section:
Zoning and sign regulations wi 11 not be affected by the historic 1 andmark
designation of the Eugene Mill and Elevator.
