HomeMy WebLinkAboutOrdinance No. 18669ORDINANCE NO . ~~p ~' An Ordinance initiating the vacation of the following described pedestrian right-of-way, to-wit: Beginning at the northwest career of Lot 7, Black ~, of Bard~11 Estates as platted and recorded in Book 35, Page 28, Lane County Plat Records, Lane County, Oregon, and running South 192.80 feet, thence north 82°40' west 15.12 feet; thence North 190.87 feet; thence east 15.OD feet to the point of beginning. Lindley PV SO-17 THE CITY OF EUGENE DOES QRDAYN AS F~LLQwS: Section 1. The City Council of the City of Eugene herein ini- bates the vacation proceedings on its own authority without peti- tion or consent of the property owners, except as provided by statute, of the above described pedestrian right~af-way. Section 2. A hearing shall be held upon the proposal to vacate the pedestrian right-~of-way as herein provided, and the hearing shall be held an the 6th day of August, 198D, at noon, Pacific .Daylight Time of said date, at the Council Chambers at City Halls Eugene, Oregon, at which time all persons will be heard upon objections or suggestions with regard to the vacation, and at said time the Council will provide for the vacation of the pedestrian right-of-way or deny such vacation, and in case the vacation is made, will rovide and P make provision for an,y damages sustained by local assessment. Section 3. The City Recorder is hereby directed to immediately publish once each week for four consecutive weeks in a newspaper pub- lished in Eugene, Lane County, Oregon, notice of the proposed vaca- tion. The notice shall give a description of the area to be vacated as herein set out; state the date when this ordinance was passed, the name of any petitioners petitioning far the vacation. and the date Ordinance - 1 1669 when the petition, together with any objections or remonstrances which may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after the first publication of the notice post, or cause to be posted, at or near each end of the proposed vacation a copy of the foregoing, which shall be headed "Notice of Pedestrian Right-of-way vacation," and which notice shall be posted in at least two conspicu- ous places in or on the area proposed to be vacated. The posting and the first day of publication of the notice shall be not less than twenty-eight ~.2 S~ days before the time set for hear- ing.
