An Ordinance repealing Ordinance No. 1866$ and initiating the
vacation of the following described public utility easement, to-wit:
The Southerly 7 feet of Lot 8, and the Northerly 7
feet of Lot 19, FOx HOLLOW ESTATES, as platted and
recorded in File 73, Slides 70 and 71, Lane County
Oregon Plat Records, in Lane County, Oregon.~Jensen EV 8D-1~
T~iE CITY OF EUGENE DoEs ORDAIN A5 FOLLOWS:
Section 1. In order to insure an adequate publication time,
Ordinance No. 18668 adopted by the Council and approved by the Mayor
on June 25, 1984 is hereby repealed.
Section 2. The City Council. of the City of Eugene herein ini-
tiates the vacation proceedings on its own authority without peti-
tion or consent of the property owners, except as provided by statute,
of the above described public utility easement.
Section 3. A hearing shall be held upon the proposal, to vacate
the public utility easement as herein provided, and the hearing shall
be held on the 13th day of August, 198Q, at noon, Pacific Daylight
Time of said date, at the Council Chambers at City I~all, Eugene,
Oregon, at which time all persons will be heard upon objections or
suggestions with regard to the vacation, and at said time the Council
will provide for the ~'acati,on of the public utility easement or deny
such vacation, and in case the vacation is made, will provide and
make provision for any damages sustained by focal assessment.
Section ~. The City Recorder is hereby directed to immediately
publish once each week for four consecutive weeks in a newspaper pub-
lished in Eugene, Lane County, Oregon, notice o~ the proposed vaca-
tion. The notice shall gave a description of th.e area to be vacated
as herein set out; state the. date when this ord%nance was passed, the

name of any petitioners petitioning for the vacation, and the date
when the petition, together with any objections ar remonstrances which
may be made in writing and filed with the Recorder of the City of
Eugene prior to the date of the hearing, will be heard and considered,
Section ~. The City Recorder shall forthwith and within five
days after the first publication of the notice post, or cause to be
posted, at or near each end of the proposed vacation a copy of the
foregoing, which shall be headed "Notice of Public Utility Easement
vacation," and which notice shall be posted in at least two conspicu-
ous places in or on the area proposed to be vacated.
The posting and the first day of publication v~ the notice shall
be not less than twenty-eight ~.28~ days before the time set for hear-
ing.
