An Ordinance repealing Ordinance No. 18669 and initiating the
vacation of the following described pedestrian right-of-way, to-wit:
Beginning at the northwest corner of Lot 7, dock 2,
of Bardell Estates as .platted and recorded in Book 35,
Page 28, Lane County Plat Records, Lane County, Oregon,
and running South 192.80 feet, thence north 82°40'
west 15.12 feet; thence North 190.87 feet; thence east
15.00 feet to the paint of beginning. Lindley Pv 80-1}
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. In order to insure an adequate publication time,
Ordinance No. 18669 adopted by the Council and approved by the Mayor
on June 25, 1980 is hereby repealed.
Section 2. The City Council of the City of Eugene herein ini-
tiates the vacation proceedings on its own authority without peti-
tion or consent of the property owners, except as provided by statute,
of the above described pedestrian right-of-way.
Section 3. A hearing shall be held upon the proposal to vacate
the pedestrian right-of-way as herein provided, and the hearing shall
be held on the 13th. day of August, 1980, at noon, Pacific Daylight
Time of said date, at the Council Chambers at City Hall, Eugene,
Oregon, at which. time all persons will be heard upon objections or
suggestions with regard to the vacation, and at said time the Council
will provide for the vacation of the pedestrian right-of-way or deny
such vacation, and in case the vacation is made, will provide and
make provision for any damages sustained by local assessment.
Section ~. The~City Recorder is hereby directed to immediately
publish once each week for four consecutive weeks in.a newspaper pub-
lisped in Eugene, Lane County, Oregon, notice of the proposed vaca-

tion. The notice shall give a descript~an of the area to be vacated
as herein set out; state the date when this ordinance was passed, the
name of any petitioners petitioning for the vacation, and the date
when the petition, together with any objections ar remonstrances which
may be made in writing and filed with the Recorder of the City of
Eugene prior to the date of the hearing, will be heard and considered.
Section 5. The City Recorder shall forthwith and within five
days after the first publication of the notice post, or cause to be
posted, at or near each end of the proposed vacation a copy of the
foregoing, which shall be headed "Notice of Pedestrian Right-of-Way
Vacation," and which notice shall be pasted in at .east two conspicu-
ous places in or on the area proposed to be vacated.
The posting and the first day of publication of the notice shall
be not less than twenty-eight ~ ~2 S ~. days before the time set for hear-
zng.
