AN ORDINANCE CONCERNING .AIRPORT FEES; REPEAI,-~
IN.G ~ oRD INANCE No . 14 6 3 5 ~ AND RESOLUTION NO
2423; AMENDING SECTION 2.440 OF THE EUGENE CODE
1971, ADDING A NEw SECTION 2.442 TO THAT CODE;
AND DECLARING AN EMERGENCY. ~ .
~'HE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: -

and Resolution No, 2423 adopted by the Common Coundil on
July 14,

Section 2. Section 2.440 of the.Eu ene Code 1971 `

amended to read and provide:. ~ ,
2.440 Air ort. = Fees and Charges, Authorization.

. Section 3, There is hereby added. to the Eugene Code 1971 a

person, firm, business, partnership or corporation selling or
delivering aviation fuels toairplanes of private and cammer-- ~-
cial operators ~ at I~~ahlon Sweet Municipal Airport shall fur~-
nzsh to the airport manager a true and correct written state-
. ment and provide copies of invoices and/or sales delivery re-
cords reflecting the date and gallons ~ of aviation fuel far
each delivery:, and shall pay to the city a .fuel f lowa e fee

of $D.45 per gallon on all gallonage delivered after August 1,
19gD.

be paid to the city's airport manager within 24 da s after the

last day of the r~onth ~ in which the delivery of the aviation

~5} The airport manager, or his designee, rna durin

normal business. hours ,and at .reasonable times and intervals,
inspect and audit the records. of any person, firm, artnershi

business or corporation delivering aircraft fuels to the Mahlon
Sweet Municipal Airport as such records relate to those deli.v~-
eries. ~.
~6~ The airport manager may grant any .supplier of air-
craft fuel and oil an exemption from or a refund of an fuel

flowage fees paid pursuant to section X37 above upon substan-
- ~ - nation ~by the supplier that the aircraft fuels are su lied

to commercial air carriers who pay a landing fee and field use
charge to the city, or to govermentally owned or operated air-
craft.
~ 7 ~ Collection of the fee provided for in section t-3 }
above may be enforced by the city by an action in any court,
and the city may recover in addition thereto, its costs,~dis-~
bursements and reasonable attorney fees for the bringin of

such action.. ~ ~ -
Section 4. The matters contained herein concern the public wel-
f are , and in order t~o prov.ide for the orderly implementation of the
fees established herein it is necessary. to provide a specific effec-
tive date, therefore, . an emergency is hereby declared to exist and
this ordinance shall .become of f ective ~ on August 1, 19 80 ~.
