AN ORDINANCE CONCERNING ANIMAL CONTROL; AMENDING
SECTION 4.355 OF THE EUGENE CODE, 1971; ADDING
SECTION 4.450 TO THAT CODE; AND DECLARING AN
EFFECTIVE DATE.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 4.355 of the Eugene Code, 1971, is hereby
amended by amending the first sentence thereof ar~d by adding in alpha-
betical order therein the following:
4.355 Dog Control -- Definitions . For purposes of sections
4.355 to 4.450 of this chapter, the following words
and phrases shall mean:
Animal agency. Any public or private organization
whether called a pound, kennel, shelter, society, or
the liken that controls, shelters, cares for or disposes
of dogs and cats as all or a part of the purposes of the
organization. Animal agency does not include a veteri-
narian in private practice, Animal agency does include
the agency's officers, agents and employees when acting
in the name of or on behalf of the agency,
Animal technician. An animal technician as defined
in ORS 656.350 who is performing duties under the super-
vision of a veterinarian.
Put to death. The taking of an act or series of
actions for the purpose of intentionally causing death.
Veterinarian. A person licensed by the State of
Oregon to practice veterinarian medicine.
Private practice of veterinarian medicine. The
private practice of veterinarian medicine has its ordi-~
nary meaning, and includes private animal hospitals or
clinics under the supervision or control of a veteri-
narian. The phrase also includes the agents and em-
ployees of a private animal hospital and clinic when
acting in the name of or on behalf of such hospital or
clinic.
Section 2. There is hereby added to the Eugene Cade, 1971, the
following section, to be numbered and provide:

4.45D Animal Euthanasia.

medicine may put to death a dog or cat under his or her care,

tion of a drug administered by the veterinarian or~animal techni~
cian.
Section 3.. That the provisions contained herein concern the
public welfare and safety, and it is necessary for the orderly im~-
plementatian of the provisions hereof that an effective date be~ pro-
vided, and therefore, the provisions contained herein shall become
effective sixty ~.G 0 7 days after the passage of this Ordinance by the
City Council and its approval by the Mayor.
