AN ORDINANCE CONCERNING MURALS; AMENDING SECTION
8.624 OF THE EUGENE CODE, 1971; AND ADDING NEW
SECTIONS 8.6 71 AND 8.6 7 2 THERETO .
THE CITY 4F EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 8.62n of the Eugene Code 1971, is hereby
amended by adding in alphabetical order therein:
8.624 Definitions .
Mural. Any pictorial. or graphic decoration, illus-~
tration, visual representation or art work, other than
a sign, which is applied directly to a structure and.
is neither used fors nor intended to achiever the pur-~
poses of advertising by:
1. The use of lettering or script which
draws attention or directs the observer to a
particular business or business location; or
2. Drawing attention to specific products,
goods, ar services by the use of brand name,
trademark, copyrights or any device which res-
tricts re-use or reproduction by others without
permission or remuneration of the owner.
Section 2. There is hereby added to the Eugene Coder 1971r a
new section to be numbered and provide:
8.671 Regulation of ~uralsR The following shall apply to
murals:
~;a~ No person shall paint or otherwise create a
mural upon any structure without first obtaining a per-
mit from the building official to da so. A separate
permit shall be obtained for each mural,
~b~ Application for a mural permit shall be made
in writing upon farms furnished by the building official.
Each application shall be accompanied by a mural per-
mit fee to be established by resolution of the council.
Each application shall contain.
1. The names and addresses of the owner of
the structure and of the person who is to apply
the mural.
2. The address or location of the structure
upon which the mural is to be applied.
3. The proposed 1Qcatian for the
aural upon the structure.
4. A set of plans and specifications that
illustrate and explain the proposed mural.

5. Such othex information as the building
official may reasonably require.
~c~ The building official shall issue a mural
permit if, after examining the application, it is de-
termined that the proposal meets the definition of a
mural contained in section 8.620.
~d~. All murals shall be maintained by a person
in charge of property in a neat, clean and attr~.ctive
condition, free of chippingr cracking, peeling, fading,
graffiti or other deterioration.
~_e~, Regulation of murals shall be governed exclu~-
sively by sections 8.005, 8.620, 8.671, 5.672, 8.845
and 8.806 of the Eugene Code, 1971.
Section 3. There is hereby added to the Eugene Code, 1971, a
new section to be numbered and prouide:
8.6?2 Murals - A peals.
~l~ An appeal may betaken from a decision of the
building official under section 8.671 to the sign code board of
appeals. Appeals may be made to the board upon a form pres-
cribed by the board, and shall include the following:
~:a~ The name and address of the appellant.
~b~ A statement that the appellant is either
the owner of the property or is the authorized
agent of the owner.
~c}. The address of the structure.
~:d~ A statement by the appellant of ~ the pre-
cise nature of the appeal and why the appellant be-
lieves that the building official w~.s in error.
~.2~. Each appeal shall be accompanied by a fee to be
e$tablished by resolution of the council, tv cover the cost of
handling the appeal. Appeals shall be filed with the building
official, who shall give notice to the appellant of the time
when the appeal wild be considered.
~~3~ Notice of hearing upon appeals under this section
shall be as prescribed in section 8.805.
~4~ Decisions of the board upon appeals under this
section shall be as prescribed in section 8.506.
~~5~ Any person aggrieved by a final determination of
the board shall have the right of further appeal to the council,
upon, written notice of appeal filed with the city ms,nager.
Further appeal must be made within ten days from the decision of
the board, and in case the building official is the appellant,
the applicant shall be notified within 48 hours if the building
official wishes to appeal the decision. The council, after
public hearing, nay accept, reject or modify the action of the
board ar the building official.
