AN ORDINANCE CONCERNING THE SEWER SYSTEM; AMEND-
ING SECTIONS 6.070, 7,010, 7.4.5, ?..020, 7.025,
7.0 3 0 , ? : 0 3 5 , 7.0 4 0 OF THE E~TGENE CODE , 19 ? 1;
.ADDING A NE~7 SECTION 7.023 TQ THAT CODE; REPEAL-
ING SECTION 7.045 OF THAT CODE; AND DECLARING AN
EFFECTzVE DATE.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Subsection ~l~ of Section 6.0?0 of the Eugene
Code, l9?l, is hereby amended to read and provide:
6.070 Sanitary Sewers and Sewage Dis psal Re ulations ~- Con-
nections Required.
~l} All structures within l60 feet of a public sanitary
sewer or of a public right-of--way containing a public sanitary
sewer discharging domestic sewage, industrial waste ar trade
waste shall be connected to the public sewer in a manner pres-
cribed by this code and shall discharge all sewage into said
system.
Section 2. Section 7.010 of the Eugene Code, 1971, is hereby
amended by amending the definitions off' Duplex dwelling unit, Multiple
dwelling unit and Sewage system, and by inserting in alphabetical
order therein the following definitions far Dwelling unit, sewer ser-
vice, and sewer user:

Duplex. ~A building designed and used exclusively
for occupancy by two families living independently of
each other.
Dwelling unit. As defined in section 9.254 of
th ~. s code .
N~ultiple dwe~.ling. A building designed for or
occupied by three or more families living independently
of each other.
Sewerage system. The equipment, pipe line system
and facilities as are needed far and are pertinent to
the disposal of sewage and water, and sewage treatment
plant or separate pipe limes for storm, surface and
subsurface water.

sewer service., includes, but is not limited to,
construction, reconstruction, extension, open-anon,
management and debt retirement of a sewerage system.
Sewer user. A facility which discharges directly
or indirectly to the city sanitary sewerage system, or
has a sanitary sewer available as provided in section
~ . 0 7 0 of ~ this code .
Section 3. Sections 7.015 and ?.02Q of the Eugene Code, 1971,
are hereby amended to res.d and provide:
7.015 intention to operate Sewerage System. ~'he council here-~
by declares its .intention by contract or otherwise, to
acquire, own, construct, eq~.ip, operate and maintain within and
without the city limits a water pollution control plant or plants,
sewers, equipment and appurtenances necessary, useful or canven~-
ient far complete storm and sanitary sewerage systems including
the reconstruction of sewers as may necessarily or conveniently
be deemed proper by the council.
7.020 Charges _ Established and Zeyied..
~_i~ Where is hereby levied and imposed on all sewer
users just and equitable monthly rates and charges for sewer
service as provided in this chapter.
~_~} Residential sewer users monthly charges for city
and regional sewer service shall be:

where V equals thevolume in gallons of wastewater.dis--
charged by the user into the sanitary sewerage
system during the month;
B equals the a~rerage B.O.D. in excess of 200 milli-
grams per litre~of the discharged wastewater; and
S equals the average suspended solids in excess
of 200 m.lligrar~s per litre of the discharged
wastewater.
Section 4. There is hereby added to the Eugene Coder 1971, a
new section to be numbered and provide:
7.023 Char es -~ Adjustments.
~.1} Upon forms. provided, any sewer user paying more
than the minimum monthly sewer user charge may apply to the city
manager or his designee to reduce the monthly charge based on:
~a~.. the. amount o~ water consumed and not dis-
charged into the sanitary sewerage system, or
~b~ the recommendation of th.e regional sewerage
system agency when the application of the for~.ula es-
tablished in subsection 7.Q20~4} requires the user to
pay a disproportionate share of the costs of regional
sewer service.
~2~ The city manager ar his designee shall investi-
gate the application and. certify to the Eugene water & Electric
Board a reduction, if any, in the applicants monthly sewer
user charges and the conditions and duration of .the reduction.
The full cost of investigating the application authorized by
this section and any conditions required by the city manager
or his designee shall be borne by the applicant. The city
managers decision regarding an application shall be final.
Section 5. Sections ?. 025, 7.030, 7. Q35 and 7.040 of the
Eugene Code, 1971, are hereby amended to read and pr~avide:
7.025 Char es - Collection and Pa meat. The Eugene water &
f Electric Board is directed to collect the rates and
charges provided for in this chapter from each sewer user.
Charges levied in subsection ~4 ~. of section 7.0~ 0 shall be
determined by th.e city ~nana~er or his --designee and certified
to the Eugene water & Electric Beard. .~l.l re~renue collected
by the Eugene ~`ater & Electric Board shall be paid monthly to
the finance officer who shall depos%t it in the `sewer opera-
tions fund" for use. in providing sewer service and such other
services as the council may direct.
7.030 Char es ~- sewer Users dot Served By Eu ene Water &
Electric Board. Sewer users not served by the Eugene
Mater & Electric hoard shall install and maintain meters~appro-

ved by the city manager or his designee which accurately re-
flect the gallons of water which pass into the sanitary sewer-~
age system. The meter shall be con~reniently available to be
read ~ by the city.
7.035 Char es - Delin uencies. The Eugene water & Electric
hoard shall enforce the collection o~ rates and charges
far sewer service and nay do sv by withholding delivery of water,
steam or electricity tp any preen%ses for which the sewer users
charges are delinquent, or by any other means of collection pre-
vided by the laws of the state or permitted by the charter and
ordinances of the city incl~udi.n~ cert~f ication of delinquencies
to the tax assessor of Vane County for collection in the manner
provided by 4RS 454.225. Rates and charges for sewer service
shall be collected monthly and i~ not paid on or before 10 days
from and after the date the same shall be payable, the rates and
charges shall be deemed to be delinquent. Any charge due which
shall not be paid when due may be reco~rered in an ~.ction at law
by the city .
7.040 Char es - ~enalt for nonpayment. In the event it be-
comes necessary to cert..%~y the sewer user fees and
charges established because of nonpayment, there shall be
added to the fees and charges a penalty in the amount of
ten percent and the total amount due shall bear interest at
the rate established in section 2.022 0~ this code from the
date of delinquency.
Section 6. That Section 7.045 of the Eugene Code 171, is
hereby repealed.
Section 7. That the prov%sion and regu~.ation o,~ sewer service
is a matter of concern to all ci;ti.zens o~ the City. ~t is also im-
portant that there be uni,forxnity throughout the area in the charges
for such services. Therefore, the City Counc%1 determines that the
provisions contained herein concern th.c ~ubl.ic ~ea~th. safety and
welfare, an emergency is hereby declared to exist, and this ordinance,
including the charges provided for herein, shall become .immediately
effective at such tune a.s th.e City o~ Springfield approves and adopts
the same rate schedule.
