That portion of the ~~orth-South alley abutting Lots 1, ~, 3, and 4, and that portion of the East-west Alley abutting Lots 4 and 5, all in Block l6, Eugene Original Plat as platted and recorded in Boak A, Page 2 of Lane County Oregon Plat Recards,~Lane County, Qregon. PROVIDED, however, that the owners of the above des- cribed property will provide public utility easements and will provide the necessary area for movement of vehicular traffic as required by the City Public works Department., ~AV 79-2 Fifth St. Public Market} On the 10th day of September, 1984, the City Council of the City of Eugene passed Ordinance No. 1869b setting a hearing to be held on the 15th day of October, 195, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation~of the above described alley. Notice was duly and regularly given of the hearing and a hearing was held pursuant to the Ordinance at the Council Chambers, at City Hall, Eugene, Oregon, on the 15th day of October, 1980, at noon, Pacific Daylight Time, and at said time and, place the Council heard all objections. s All persons owning property abutting upon the alley to be vacated have consented to the vacation and applied for the same. THE CITY OF EUGENE DOES ORDAIN AS FOLLow5. Section 1. The City Council o~f the City o~ Eugene finds that due and regular notice of the hearing vas published and posted as by law required and no Valid objections have been jade at the hearing or Ordinance - 1 187/3 filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the alley. Section. ~. The hearing eras held on the 15th day of October, 1980, at noon., Pacific Daylight Tide, at the Council Chambers, City fall, Eugene, Lane County, Oregon, and all matters necessary to be done in the premises ha~re been duly and regularly completed. Section ~. The hereinabp~e described alley is hereby vacated, and the alley so vacated shall re~e~t pursuant to the statutes of the State of Cregan. Section 4. the City Recorder is hereby directed to file a cer- tified copy of this ordinance with the Recorder of Lane County, Oregon, together with a map or plat Qf said property, and a certified copy of this ordinance shall be filed with the Zane County Assessor and another certified cagy shall be filed with the Lane County Surveyor.
