An Ordinance initiating the vacation of the following described
easement, to~-wit
The northerly 1G feet of a 30 foot storm drainage
easement located on and along the southerly boundary
of Lots S, 9, lQ, and ll, except for the westerly 7
feet of lot 9 and the easterly 7 f eet of lot l0 , all
in Birdnest 5~ubdivision as platted and recorded in
File ?3, Slide 35G in Lane County Plat Records, Lane

THE CITY OF EUGENE DOES ORDAIN AS FoLLOwS:
Section 1. The City Council of the City of Eugene herein ini--
bates the vacation proceedings on its own authority without peti-
tion or consent of the property owners, except as provided by statute,
of the above described easement.
Section 2. A hearing shall be held upon the proposal to vacate
the easement as herein provided, and the hearing shall be held on the
3rd day of December, 19$4,. at noon Pacific Standard Time of said date,
at the Council Chambers at City Hall, Eugene, oregon, at which time
all persons will be heard upon ob~eet.ons or suggestions with regard
to the vacation, and at said tine the Council will provide for the
vacation of the easement or deny such vacation, and in case the vaca-
tion is made, will provide and make provision for any damages sus~-
tamed by local assessment.
Section 3. The City Recorder is hereby directed to immediately
publish once each week for four consecutive weeks in a newspaper pub-
lished in Eugene, Lane County, Oregon, notice of the proposed vaca-
tion. The notice shall give a descript%on of the area to be vacated
as herein set out; state the date when this ordinance was passed, the
name of any petitioners petitioning far the vacation, and the date

when the petition, together with any objections or remonstrances which
may be made in writing and filed with the Recorder of the City of
Eugene prior to the date of the hearing, will b.e heard and considered.
Section 4. The City Recorder shah. forthwith and within five
days after the first publication of the notice post, or cause to be
posted, at or near each end of the proposed vacation a copy of the
foregoing, which shall be headed'Notice of Easement Vacation," and
Which notice shall be posted in at least two conspicuous places in or
on the area proposed to be vacated.
The posting and the first day o~ publication of the notice shall
be not less than twenty-eight X28 ~ days before the time set for hear-~
ing.

TO ALL PERSONS WHOM IT MAy CONCERN;
NOTICE IS HERESY GIVEN that at a meeting of the City Council
of the City of Eugene, held at the Council Chambers at City Hall,
Eugene, Oregon, on the 22nd day of October, 1980, there was passed
by the City Council and approved by the Mayor of the City of Eugene,
Lane County, Oregon, an ordinance setting a hearing to be held on
the 3rd day of Decearnber, 190, at 12:00 noon, Pacific Standard Time,
at the Council Chambers at City Ha11,~Eugene, Oregon, for the purpose
of hearing remonstrances and protests against the vacation by Ordi-
nance of the City Council of the following:

The City Council will consider and act upon the proposed vaca--
tion on the 3rd day o~ December, l9$0, at 12.00 o'clock noon,
Pacific Standard Time, at the Council Chambers at City Hall, Eugene,
Oregon, and will consider an ~r.:.d,inance. ~racating th.e above., All per-
sons having objections thereto or remonstrances or protests are here-
by notified to present the same to the City Council in writing prior
to said hearing or at said time a place.
