HomeMy WebLinkAboutOrdinance No. 18720ORDINANCE NO. 8~1 ~O AN ORDINANCE CONCERNING ~IEHICLES IN THE MALL; AMENDING SECTIONS 5.565, 5.570, 5.575 AND 5.5$0 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY CF EUGENE DOE5 ORDAIN AS FOLLOWS: Section 1. Subsection t:4~ of Section 5.565 of the Eugene Code, 1971, is hereby amended to provide: 5.565 Vehicles in Mall - Prohibited. ~4~ Except for vehicles of the fire department, police department, and maintenance operations of the city, no person shall operate a motor vehicle within the Eugene Pedestrian Mall without having obtained a permit from the parks and recreation director as provided in this chapter. Section 2. Section 5.5?0 of the Eugene Code, 1971, is hereby amended to providep 5.570 ~Tehicles in Mall -~ Permit, Fee, Damage Deposit, ~1~ Any person desiring to operate a motor vehicle within the mall must file with~the parks and recreation direc- tor a written application for a permit. He shall state the destination point, date and time, type and weight of vehicle, and purpose for which the motor vehicle access is needed. ~Z~ It shall be the duty of the parks and recreation direci:ar or his representative to examine the application and to determine the proper access route, the time when the route can be used, and any special precautions which may be neces- sary to safeguard the public or the mall structures and. sur- faces. If the permit is granted, it shall specify the require- ments as determined by the parks and recreation director, and shall also designate the mall surfaces which are designated for pedestrian use only, and on which vehicles shall not travel. The applicant shall pay a fee of $5.00 to caner the cost of issuing the per.~it and inspecting the access area,. The appli- cant shall also deposit an amount equal to the parks and re- creation director's estimate of the cost to restore any of the mall facilities which will be disturbed as a result of the applicant's operations. Section 3, Subsection ~Z~ of Section 5.575 of the Eugene Code 1971, is hereby amended to provide ordinance - 1 IBT2o 5.575 vehicles. in Mall -- Permittee obligation. ~~} The permittee shall have in his possession the permit issued by the parks and recreation director when access to the pedestrian mall. area is taken and should be prepared to present the access permit to mall personnel or police upon re- quest. Section 4. Section 5.580 of the Eugene Code, 171, is hereby amended to provide:. 5.584 vehicles in Mall ~- Utility Ca~npanies, Private Contrac- tors. ~1} Utility companies which hold franchise agreements with the city may be issued annual permits, which will permit routine access to the pedestrian mall area for inspection of equipment and facilities. These permits shall also specify the access routes, weight of vehicles, and the time that the access may be used. The annual permit shall be issued by the parks and recreation director and no fee wil,1 be charged for the per- mit. Utility companies shall have the same responsibilities and liabilities for their operations within the pedestrian mall. area as other permittees. ~Z~ ~~hen ~ it is necessary for utility companies or pri- vate contractors to open holes in the surface of the mall area for construction of new facilities or repair of existing foci-~ lines, they shall obtain a permit and comply with all require- ments of Chapter 7 of this code. The per~rnit issued by the parks and recreation director shall specify the access requirements as contained in section 5.570. Section 5. That .the provisions contained herein concern the public welfare and safety, and in order to provide for the orderly administration of the issuance of permits an emergency is hereby de- clared to exist and this ordinance shall become effective immediate- ly upon its passage by the City Council and approval by the Mayor.
