HomeMy WebLinkAboutOrdinance No. 18722CRD INANCE NO , ~ ~~ ~~ An Ordinance initiating the vacation of the following described streets and alleys, to-wit: 29th Avenue between Amazon Parkway and Hilyard Street; 32nd Avenue, from the west margin of Hilyard Street west a distance of 178 feet; the alley between 32nd Avenue and 33rd Avenue, from the west margin of Hilyard Street west a dis- tance of 176.5 feet; the alley between 33rd Ave- nue and 34th Avenue from the west margin of Hil- yard Street west a distance of 176.93 feet, all as mare particularly described in Exhibit "A" attached hereto and incorporated herein by ref- erence. City of Eugene Sv 8~-4~ THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene herein ini- tiates the vacation proceedings on its own authority without peti- tion or consent of the property owners, except as provided by statute, of the above described streets and alleys. Section 2. A hearing shall be held upon the proposal to vacate the streets and alleys as herein provided, and the hearing shall be held on~the 14th day of ~Tanuary, 1981, at noon Pacific Standard Time of said date, at the Council Chambers at City Hall, Eugene, Oregon, at which time all persons will be heard upon objections ar sugges- tions with regard to the vacation, and at said time the Council will provide for the vacation of the streets and alleys or deny such vacation, and in case the vacation is made, will provide and make provision for any damages sustained by local assessment, Section 3. The City Recorder is hereby directed to immediately publish once each week far four conGecutive weeks in a newspaper pub- 1is~~ed in Eugene, Lane County, Qregan, notice of the proposed vaca-- Ordinance - 1 18~2z tion. The notice shall give a~ description of the area to be vacated as herein set out; state the date when this ordinance was passed, the name of any petitioners petitioning for the vacation, and the date when the petition, together with any objections or remonstrances which may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after the first publication of the notice post, ar cause to be pasted, at or near each end of the proposed vacation ~. copy of the foregoing, which shall be headed "Notice of Street and Alley Vaca- tions," and which notice shall be posted in at least two conspicuous places in or ors the area proposed to be vacated. The posting and the first day of publication of the notice shall be not less than twenty-eight ~,28~ days before the time set for hear-- ing .
